YUEL LEE TRIAL DEFERRED BY JUDGES' ACTION Ades' Plea For Change Of Venue Goes To Court Of Appeals STATE AID PLEDGED IN HANGING PROBE Support Promised Every Effort At Punishment Of Mob Members (Continued -from Page 1) at the leaders but carrying it to every other person who took part, and who can be identified.' Has Confidence In Bailey "I have confidence in Mr. Bailey and believe that he will do exactly what he says, but in the face of this outrage, which is of State-wide importance, it is my duty to give him all the assistance within my power. "Under the authority conferred on me by the Constitution I have directed the Attorney-General to cooperate with the State's Attorney of Wicomico county in the vigorous prosecution of the perpetrators of this crime. The Attorney-General will have behind him every agency which the State can supply for his assistance. "There remains the question of the effect of this lynching upon the case of Orphan Jones (alias Yuel Lee). Wants Prompt Trial Of Lee "It is imperative that Orphan Jones be tried, wherever he is to be tried, at the earliest possible moment. Jones' attorney has appealed to the Court of Appeals from the order of the lower court removing his case to Dorchester county. I am advised that the Circuit Court will not try the case until this appeal has been disposed of, and that this will delay the trial for another week. 1 hope that every facility of the Court of Appeals and of the Circuit Court will be directed to the trial of Orphan Jones as promptly as is possible. "As things stand now, the Circuit Court has decided that this case will be tried in Dorchester co'«nty. That is their responsibility and the Governor has no power or authority under the law to interfere with it. 1 am in receipt today of letters from Chief Judge (John R.) Pattison and State's Attorney (James A.) McAllister advising me that in their opinions the State militia will not be needed for the protection of either Jones or Ades, but that the local authorities, with the possible addition of the State police, can do all that is needed. Feels Protection Necessary "These letters were written before the lynching of Williams last night, and in view of that occurrence and of the other occurrences and developments, I have decided that, whatever may be the opinions which the local authorities now hold, it is my duty as Governor of the State to take the steps which I consider necessary to assure protection to both Jones and Ades, if the judges adhere to their determination to try the case in Dorchester county. "I need not specify what the protection is which will be afforded. It Is enough to say that it will be sufficient to safeguard Jones and Ades at their trial." Orders Lee Case Record Sent To Appeals Court CHIEF JUDGE JOHN R.WATTISON show the same "emphatic devotion to the sanctity of justice and our law courts in this case" as, he said he understood, they show "to law as represented by the Volstead act." Gets Letter From Berger Governor Ritchie received a letter from Louis Berger, secretary of the Baltimore branch of the International Labor Defense League, demanding that the league and Negroes be represented on any investigating committee the Governor might appoint. Mr. Berger also called upon the Governor to use his authority to see that leaders of the mobs that have figured in the Lee case also are prosecuted, "including Mayor Byrd," of Snow Hill. Mr. Berger said there was no evidence that Williams had committed murder; that there had been no witnesses present when the shots that wounded the Negro and killed Mr. Elliott were fired. He also said that the league will make its own investigation of the lynching and the murder that preceded it. Child "Terrorist," Charge To Godfrey Child, State's Attorney of Worcester county, who is to prosecute Lee and who Friday night placed the blame for the lynching at Salisbury on the league's activities, the league sent a telegram of defiance, accusing him of "terrorizing." The telegram follows: "Your threats of further violence in your circuit will not prevent the International Labor Defense from projecting workers against iegal lynching by you and your courts. Eastern Shore mobs may dictate the orders of your courts but we will still lead the workers in their organized fight against your terrorizing." Early yesterday afternoon, Mr. Ades received the following telegram from Salisbury: "Have Negro murderer here. Slightly dilapidated. Interview guaranteed. Same treatment awaits others." It was signed "John J. Justice." . Rabbi Israel's Message The message from Rabbi Israel follows, in part: "What is going to be the answer of the constituted authorities? Are we going to witness in Maryland the usual conclusion to these barbaric scenes? Is a travesty of a coroner's inquest going to gather with fake solemnity and declare that the Negro came to his death 'at the hands of persons un-
