278. "Western District, February 4, 1903. Thomas F. Fa man, Marshal of Police, Sir:- About 9.40 P. M., January 30,1903, a Wrestling Match between Americus and a man named Wiley was in progress at Germania Maennerchor Hall, on Lombard street neat Eutaw. The Hall was filled to its utmost capacity and the crowd worked up to almost fever heat. Three or four gentlemen pushed their way through the crowd, and stood in the aisle. I approached them and in a gentlemanly manner, requested them not to blockade the aisle; as it was against the law. One of them said "We want to get to our seats". I replied, well you can see for yourselves gentlemen, there are no vacant seats up here. One of them then said, " We want the usher". I told them there was no usher here, but if they would go back and go to the centre of the Hall they might find an usher. I again called their attention to the aisle being blocked by them standing there, and that they must vacate. They then left and that was the last I saw of them. We had no argument, and beyond the above facts, nothing else transpired. RESPECTFULLY, JOHN J. FULLEM, Captain.* The Secretary was directed to inquire from Messrs. Payne and Sams if they desired to prefer formal charges against Captain Fullem. Papers filed as Exhibit No. 938. Complaint against Detective Thomas A. Berney. Communication, as follows, was received, and ordered referred to the Marshal for investigation and report:- "Mr. Upshur, Sir:- Detective Berney is still keeping up his drunk. On Wednesday last he was put on a Carey street car at Conway & Charles streets by Officer Tom Williams, between 2 and 3 o'clock, who is one of his pals, and he took a cud of tobacco from his mouth and threw it in a little colored boys face, and Officer Williams and the conductor saw it. You can find Berney in Tom Ryan's on Light street Wine-kier's on Camden street drinking all day. He claims to have a great pull with the captain whom he calls a good fellow. He severely reprimanded Officer Bracken for reporting a saloon-keeper and also threatened him, and he did the same thing with Lieutenant Morheiser for arresting a saloon-keeper several weeks ago. If you would send some trusty Sergeant in South Baltimore he could tell you what is going on. Berney says the Captain is a good fellow and it looks like, for Berney has bought two houses in less than eighteen months. He says he controls about ten day officers." William Prestonf c.
