Halbert, the property particularly mentioned and described in said bill; the bill sets forth the following from the preamble of the said deed:
"Whereas, about November 23, 1851, said Isaac Tyson, Jr., did sell to C. and F. Miller the within described property at the rate of $20.00 per acre, payment for which was agreed to be made in the sum of $250.00 casih and the balance with legal interest thereon in three years from date, said sum of $250.00 was then paid and acknowledged by said Isaac Tyson, Jr.

The bill further states that by the last will and testament of said Elizabeth A. Halbert the property conveyed by King and Tyson aforesaid was; devised to Susanna Halbert; that the said Elizabeth A. Miller and F. Miller are to the best of the information and belief of the plaintiff nonresidents of the State of Maryand; that prior to the execution of the said deed, they disappeared and have never been heard from since; that the plaintiff does TfoT'lth^^Tvfrgth-eT—or~~ not "% eTtner or both are living or dead and whether or not they left any heirs.
