This paper has been patient in waiting for some subscribers to pay up, but with the existing conditions staring It squarely in the face, the time has arrived when patience ceases to be a virtue. JUDGE BURKE. It wasi a very deserving- tributewhioCn, the friends of former Judge N. Charles Burke paid him Thursday night when they gave him a testimonial dinner at the Southern Hotel. It was a distinguished company, made up of the highest officials of the State, City and County, and the leading members of the bar, as well as a number of prominent laymen.^ Few jurists have ever sjerved the people for a longer period, or with, more distinguished ability, than Judge Burke. During his term as Associate Judge of the Circuit Court for Baltimore county he endeared himself to the people by the fearless and impartial manner in which he meted out justice. His published decisions as a member of the Court of Appeals will stand out for al time as a monument to his learning, his ability and his abiding sense of justice. The Jeffersonian heartily seconds everything that was said at the dinner in commendation of Judge Burke*s public services, congratulates him upon this well-dea|erved honor and wishes him well forever hereafter in his pursuits as a private citizen. ORDER OF PUBLICATION. The object of this suit is to procure a divorce a vinculo matrimonii by the plaintiff, Florence E. Canfield, from the defendant, Charles E. Canfield. The Bill recites that the parties were married in the City of Chicago, in the State bf Illinois, on April 3rd, 1915, by the Reverend Dr. Clemens, a Minister of the Gospel, and lived together up to the first day of September, 1915, when he deserted her in the City of Chicago, State of Illinois; that the plaintiff has been a resident,of the State of Maryland for more than two years prior to the filing of this bill of complaint, while the defendant, Chas.. E. Canfiel^, is a nonresident of the State of Maryland, his last known place being the City of Chicago, State of Illinois; that there was no issue as the result of the said marriage; that though the conduct of your oratrix toward her slaid husband has been affectionate and above reproach, the defendant Charles E. Canfield, her husband, has without any just cause or reason abandoned and deserted her, and declared his intentions to live with her no longer; that said abandonment has- continued' uninterruptedly for more than three years, is deliberate and final, and the separation of the parties, is beyond any reasonable hope or expectation of reconciliation. It is therefore ORDERED by the Circuit Cour.t for Baltimore County, this 26th day of May, A. In other words^ the charter should be judged on its merits, free from any purely political considerations * The Jeffersonian shall from time to time discuss various provisions in the new proposed charter, in the hope of i aiding the voters to arrive at a cor-, j rect decision on November 2, when it ' comes up for adoption or rejection. i. CHAUTAUQUA. The success of Chautauqua this season is due absolutely to the "pep" and enthusiasjm injected into the project by the "live wires" of the Black & Decker Mfg, Company, yet we must not overlook the fact that credit is also due the ladies who were on the ticket . committee. The Chautauqua campaign of 1920 has gone upon record as the best in the history of the county-seat, simply because that community spirit which should exist was stimulated by an organization which often makes up its mind to put a thing across, and does it. The guarantors will not „ have one penny deficit to pay, as the Chautauqua has gone "over the top." .»The object of the petition filed in the above proceedings by Patrick W. Scott and Elizabeth Scott, his wife, is the adoption of said infants by the petitioners and for a change of name of said infants from Helen Scott Cooper and Stanley Scott Cooper to Helen Scott and Stanley Scott, respectively. The petition states tfcat the petitioners resie in Baltimore County and have the guardianship and custody of said infantsi since the 29th day of February, 1916; that the mother of said infants is dead and the whereabouts of the father unknown; that it would be to the. interest and advantage of said infants that their names be changed as prayed and that their general welfare would be promoted by the adoption. (I) Courts and Records To provide for recording, indexing and keeping indexed all records in the office of the Clerk of the Court, Register of Wills and of the records of the Commssioners and County Council to the extent that such matters are not provided for by general law; to provide for designating Justices of the Peace who may constitute a county court, the keeping of its records, and to fix the compensation of all Judges thereof, and all officials connected therewith, and to require an accounting to the county for all fees collected in connection therewith, and to fix official bonds and regulate fees of the remaining Justices in the county. (K) Health and Nuisances To prevent, , abate and remove nuisances; to prevent the introduction of contagious diseases into such county, to regulate the places of manufacturing soap and candles and fertilizers, slaughter houses, packing houses, canneries, factories, workshops, mines, manufacturing plants, and any and all places where offensive trades may be carried on, or which may involve or give rise to unsanitary conditions or conditions detrimental to health. Nothing in this Article or Section contained shall be construed to affect in any manner any of the powers and duties of the State Board of Health, or any Public General Laws of the State relating to the subject of health. (L) Highways, Bridges and Streets To provide for grading, shelling, graveling, paving and curbing, or for re-grading, reshelling, regraveling, re-paving, recurbing, and repairing any street, road, lane, alley, footway, bridge, culvert, highway or public place within said county, or any part thereof, now or hereafter condemned, ceded, opened, widened, extended or straightened as public property; and for assessing the cost of any such work upon the assessable basis of the county; to compel by fine or penalty the owner or possessor of any lot to grade, sion, each member shall receive the regrade, ;ave, repave, or repair the footways in front thereof; to regulate the opening of street surfaces. (M) Live Stock To regulate the conditions under which dogs, cows, sheep, pigs, cattle and live stock of any and every kind may be at large, or may pass over the streets, roads, alleys, lanes, bridges, highways and public places. (N) Fish and Game To pass local fish and game laws. (0) Fences To regulate the making and keeping secure of fences and provide for the procedure to enforce the rights of the parties, and a lien for repairs made by an owner not in default. (P) Assessments, Levy and Col-- tion o$ Taxes To direct the class or sub-class of improvements on land and personal property, which shall be made subject to the county tax levy, and to provide for the levy thereupon and upon the value of land in accordance with Article 15 of the Declaration of Rights of the Constitution of Maryland as amended, of any sum which may be necessary to pay and discharge the principal and interest of any loan which may heretofore have been obtained, or which may hereafter be obtained by such county, according to law, and to create a sinking fund to meet the liabilities thus incurred, and leyy upon the property so subject to taxation from time to time such sums as may be necessary to provide therefor; as well as to collect from such property so subject to the levy such sums as may be necessary for the support and maintenance of the county government. To provide for the prompt collection of all taxes due the county, and for the sale of real estate, as well as leasehold and personal property, for the payment of the same. To rectify errors in the assessment of property; to provide for the reduction or abatement of assessments improperly made, and for the reimbursement of moneys paid in consequence of such errors. (Q) Bonds or Evidences of Intebt-edness To provide for the borrowing, on the faith and credit of the county, and for the corporate uses of the county, of any sum or sums of money not exceeding in the aggregate with any outstanding bonds seven per centum upon the assessable basis of such county, and to issue bonds or other evidences of indebtedness for the same, in such sums and payable at such times as may be prescribed; provided that any bond issue or borrowing of money in any one year in excess of one-fourth of one per cent, of the assessable basis shall be submitted to the voters of the county for approval under regulations to be prescribed. (R) County Officers To provide for the appointment and removal of all county officers except those whose appointment or election is provided for by the Constitution or Public General Law, and to establish a merit system, if deemed desirable, in connection with the appointment of all county officials. and employees not elected or appointed under the Constitution and the Public General Laws; to fix the qualifications and terms of office of such county executive author^ as may be established and to fi-^eh , compensation. . The foregoing or other enumeration of powers in this. Article shall not be held to limit the power of the County Council, in addition thereto, to pass all ordinances, resolutions or by-laws, not inconsistent with the provisions of this Article or the laws of the State, as may be proper in executing and enforcing any of the powers enumerated in this Section or elsewhere in this Article, as well as such ordinances as may be deemed expedient in maintaining the peace, good government, health and welfare of the County. Provided, that the powers herein granted shall only be exercised to the extent that the same are not provided for by Public General Lave; provided, however, that no power to legislate shall be given with reference to licensing, regulating, prohibiting or submitting to local option, the manufacture or sale of malt or spirituous liquors. Any judicial declaration of the invalidity or unconstitutionality of any clause or power herein set forth shall not be construed to declare invalid any other part of this Article or of this Article as a whole. ARTICLE IV. 1. In case of vacancy in the office of the presiding officer by death, resignation or permanent disqualification, or for any other cause, the member of said Council who may have been selected to take his place in such circumstances or upon the happening of a vacancy from any cause in said office, shall succeed to the duties of said officer in all particulars until a successor to said presiding officer is elected. And it shall be the duty of said County Council at all times to provide that some member of its body shall have been selected in readiness should occasion require to assume and discharge the duties of said officer until his successor is elected. 2. It shall be included in the duties of said County Manager and of any one filling his place, to see that the laws, ordinances, resolutions and all matters relating to the administration and welfare of said Baltimore County are observed and faithfully executed, and he shall, as soon as practicable after the first day of January in each year, submit to the said County Council a report of the general state of the County with an accurate account of the money received and expended during the previous year. Said report shall be published once in two newspapers published in 3aid County for the information of the inhabitants of said County. He thall have general supervision over all departments conducting and responsible for the welfare of the said County and its interests. He shall have power to call for reports from time to time either orally or in writing and all of said departments are required by this Charter promptly and fully to make such reports as said County Manager or said Council may cill for and in the manner called for. It shall further be his duty to see that each of said departments is efficiently conducted and that the duties of said department are promptly performed. ARTICLE V. 1.
