THE PETITION OF THE SAFE DEPOSIT AND TRUST COMPAN? OF BALTIMORE, A BODY CORPORATE, TRUSTEE, ETC., vs. HELEN WINSLOW, ET. AL. IN THE CIRCUIT COURT FOR BALTIMORE COUNTY, IN EQUITY. NEW ADVERTISEMENTS The object of this suit is that jurisdiction over the trust estates created and existing under the Will and Codicils thereto of Caherine C. Lanahan, deceased, may be continued by the Court that the rights of certain parties interested thereunder may be determined and the Petitioner protected in the discharge of its duties, as Trustee under said Will. The petition states that Catherine C. Lanahan, late of Baltimore County, State of Maryland, died February 13, 1920, leaving a last will and testament and codicils thereto," all duly admitted to probate in the Orphans' Court of Baltimore County and now of record in the office of the Register of Wills of said County; that Letters Testamentary upon the estate of said deceased were granted by said Court to N. Charles Burke, the executor named in said will, who fully administered upon said estate in said Court, who has paid and satisfied all legacies bequeathed by said will and codicils and who hasi paid all estate and income taxes due by said estate to the Government of the United States; that said executor paid to the State of Maryland all collateral inheritance taxes payable on said estate at any time under the laws of said State, such taxes on the principal of the pecuniary trust estates hereinafter referred to having been paid by him out of the corpus of the residuary trust estates created by said Will, so that as each pecuniary trust estate is terminated there is to be retained by the Petitioner in making distribution of the principal thereof, where the whole principal does not by the terms of said Will or Codicils revert to 'said residuary trust estates, the amount of such taxes paid thereon, for the benefit and enlargement of the corpus of said residuary trust estates; that said N. Charles Burke was named by said Will as Trustee of the various trusts /created thereby and by said Codicils entered upon and discharged his duties, as Trustee, until his death on December 8th, 1923; that from May 19th, 1920, said Trustee administered said trusts under the supervision of this Court; that under Item Fifteen of Article Two of said Will, the Petitioner, the Safe Deposit and Trust Company of Baltimore, succeeded said N. Charles Burke upon his death, as Trustee of the various trusts created by said Will and Codicils and to all the powers and authorities vested in said deceased Trustee and his successor or successors; that Petitioner now holds the corpus of the trust estates created and existing under said Will and Codicils; that no part of said corpus has been set apart for any of said trusts, but the whole thereof is held undivided and for the benefit of all persons interested therein; that said deceased Trustee with the approval of the Court, paid to the respective beneficiaries of the various pecuniary trust estates, income of 5 per cent, per annum on the gross amount of the corpus of their respective trust estates without deduction of collateral inheritance tax or costs other than Thustee's commissions; that the Petitioner believes the rate calculated and paid as aforesaid to be fair to all parties interested and is desirous of continuing the same plan; that the Testatrix left surviving her certain named persons who are her heirs-at-law and next of kin; said Petition sets forth various pecuniary trusts which failed to take effect or have been terminated for the reasons therein set forth, and it also sets forth certain other pecuniary trusts created and existing under the terms and provisions of said Will and Codicils; and it also sets forth that the bequest of $10,000. in trust for Eva J. Cockey for life with remainder over as in said Will set forth was adeemed by the Testatrix to the extent of $8,000. thereby reducing said bequest to $2,000 awfully set forth In said Petition; said Petition also sets forth the interests of the various persons who are interested in the residuary trust estates, and also sets forth the names of such persons and states which of them are minora and the names of their Guardians; said Petition also states that Mary Crozer Page Brown, one of the grandnieces of the Testatrix, was born on March 23rd, 1920 and states she has heretofore shared in the distribution of the income from the trust estate and that while the Petitioner believes she is so entitled, it desires to have it finally adjudicated that the said Mary Crozer Page Brown comes within the class of grandnephews and grandnieces living at the death of the Testatrix and is entitled to a distributive share of the income; said Petition also states that the of income to some of the beneficiaries on account, and that the Petitioner is desirious of making payments from from time to time to the life beneficiaries in the residuary trust estates, in more frequent intervals than half-yearly, believing it to be more advantageous to them to do so, making a final payment and complete settlement semi-annually in June and December of each year. Said Petition states that all parties defendant to the Petition are over the age of 21 years, except as " therein stated, and that said defendants include the following, who are non-residents of,the State of Maryland, viz: Helen Winslow, who resides at The Esmonde, 12th and Spruce Streets, Philadelphia, in the State of Pennsylvania; Burnside Winslow, who resides at 173 Orang-e Street, New Plaven, in the State of Connecticut; Louise Bruner, who resides at Hotel Cecil, London W. C, England; Eliza K. Delihant and Cecelia A. Taylor, both of whom reside at 4107 Gosnold Avenue, Norfolk, in the State of Virginia; Regina Burke Roland, who resides at 606 W. 137th Street, Apartment 3-B, New York City, in the State of New York; Eliza O'Neill, who resides at 37 Goden Street, Belmont, in the State of Massachusetts; Elizabeth Smith Lewis, and Mary E. Lewis and Catherine L. Lewis, infants, under the age of twenty-one years, residing with their mother Elizabeth Smith Lewis at Ivy Depot, in the State of Virginia; Mathilde Lewis Wood, residing at 46 Vandevender Street, Princeton, in the State of New Jersey; Howell C.
