ORDER OF PUBLICATION. LEO A. SCHNEIDER vs. JOHN H. FINKEN. IN THE CIRCUIT COURT FOR BALTIMORE COUNTY, IN .EQUITY. The object of this suit is to secure a sale of a fee simple lot of ground situate in Baltimore County, of which the plaintiff and the defendant are seized and for a division of the proceeds among the parties entitled thereto. The Bill of Complaint states that by deed dated June 2, 1907, and recorded among- the Land ecords of Baltimore County in Liber W. P. C. No. 312, folio 583, Harry E. Mann and wife conveyed unto John H. Finken and Annie M\ Finken, his wife, in fee simple, all that lot of ground situate in Baltimore County and described as follows: Lot numbered four hundred and forty-one (441) on Elm Avenue as shown on the plat of Addition to Overlea, which plat is recorded among said land records in Plat Book J. W. S. No. 2, folio 196. That thereafter on November 27, 1914, the said Annie M. Finken, by decree of the Circuit Court No. 2 of Baltimore, obtained a divorce a vinculo matrimonii from said John H. Finken, and that by virtue of said decree the said John H. Fmken and Annie M. Finken became tenants in common in the lot above described. That said Annie M. Finken subsequently intermarried with one John C. Gardner, and she and her said husband by deed dated January 26, 1924, and recorded among said Land Records conveyed unto your orator all her right, title and interest and estate in the lot of ground aforesaid. That by virtue of the last mentioned deed, the title to said lot is now vested in fee simple in your orator and the defendant as tenants in common. That said lot of ground is not susceptible of partition without loss or injury to the parties entitled to interests therein as above stated and that in order to make a division thereof it will be necessary that said lot be sold and the proceeds thereof be divided among the parties according to their respective in^erets. That the defendant is a non-resident of the State of Maryland, his whereabouts being unknown, and it is unknown whether he is living or dead. The Bill prays that a decree be passed for the sale of said real estate and that the proceeds be distributed among the parties entitled thereto according to their respective interests, and for general relief. It is thereupon ordered by the Circuit Court for Baltimore County in Equity, this 6th day of March, 1924, that the complainant, by causing a copy of this order to be inserted in some weekly newspaper published in Baltimore county once a week for four successive weeks before the 7th day of April, 1924, give notice to the said John H. Finken, a non-resident of the State of Maryland, of the object and substance of this bill, and warning him to be and appear in this Court in person or by Solicitor On or before the 23d day of April, 1924: to show cause, if any he may have, why a decree should not be passed as prayed.
