AN ORDINANCE
To prevent nuisances and to enforce useful
regulations -vithin ihe city of Baltimore.
I. Tie it enacted and ordained by the mayor
and city council of Hahinwre, That the may-
or be, and he is hereby authorised
to appoint a suitable number of city consta-
bles, whose duty it shall be to visit the dif-
ferent parts cf the city assigned them and
to give information to the mayor or other
magistrate, of all nuisances -within the same ;
also of all obstructions and impediments in
the streets, lanes and alleys, and of offences
committed against the laws and ordinances
of the city, and of the names of the offen-
ders and witnesses, to the end that prose-
cutions may be ceuunenced and obedience
enforced to the regulations for the well go-
verning of the city ; and generally to do
and perform all such other matters and
tilings as the mayor shall reasonably require ;
and lh.it a sum not exceeding five hundred
dollars annually be and is hereby appropriat-
ed as a compensation to the said constables
for the due and faithful discharge of the se-
veral duties prescribed by this ordinance ;
and the mayor is hereby directed to apporti-
on the aforesaid sum, or any part thereof
in such manner as shall appear to him best
calculated to carry this ordinance into
effect.
II. And be It enacted and ordained, That
there be two superintendants of the streets,
one for the East, and the other for the
West side of Jones's Falls annually appoint-
ed (each of whom shall have and receive the
annual salary of four hundred dollars,) whose
duty it shall be, under the direction of the
moyor to cause to be removed the dirt, filth
and manure found in any of the streets,
lanes and alleys within the city of Balti-
more t<> convenient placgs, and there to
sell and dispose of the same in such manner
and upon such terms, as the mayor shall
consider most for the advantage of the cor-
poration ; or with the approbation of the
mayor to sell or others ise dispose of said
dut and rn.an.ure, pro,ided that the same
whin'scraped up shall be removed, from said-
streets, lanes and alley's within hveiity-four
hours thereafter, if the weather will admit,
and neither of the superintendants shall be
the owner of any cart that may be employ-
ed in the cleansing of the. street, or receive
directly or indirectly any benefit from the
carts employed in removing the dirt from
the said streets. And it shall be the duty
of the said superintendants to potice and
repoit to the mayor all breaches of the ordi-
nances of this corporation, which shall
come to his or their knowledge, and to
which they shall diligently attend and in-
quire, and shall comform to and execute
all orders which they shall receive from the
mayor or the commissioners of health, con-
formably to any of the ordinances of this
corporation.
III. And be it enacted and ord incd. That
if any owner or driver of any waggon, cart or
other carriage, shall place any such waggon,
cart, or other carriage or horses, on any
street, lane or alley of this city, so as to ob-
struct the passage of any other carriage, or
shall surfer the same therein to remain when
not in use for a longer time than twenty
four hours, or a stage for hire longer than
twelve, hours such owner or driver shall for-
feit and pay for every such offence, the sum
of ons dollar.; and for every twelve hours
the said waggorij cart or other carriage or
horses shall continue in any and every of
the said streets, lanes and alleys thereafter,
one dollar.
IV. And be it enacted and ordained, That
if any person shall fire or discharge any gun,
pistol or fire-arms within the city, unless
it be on sortie occasion of military parade
and then by the order of some officer hav-
ing the command, every such person for
every such offence, shall forfeit and pay a
sum not exceeding five dollars.
V. And be it enacted and ordained, That
if any person or persons shall cast, place or
lay, or cause to be cast, placed or laid, a-
ny rubbish, oystersheJls, filth, shavings,
stable manure, or offals of his her or their
trade, business or occupation, or any rubbish
from ' buildings, cellars, or backyards, fire
wood, coal, barrels, hogsheads, boxes, or o-
ther packages, wares, or merchandize, or any
empty boxes, barrels or hogsheads, or any
trough for watering horses or cattle, in any
street, lane or alley, of the city of Batimore,
and shall not remove the same on the same
day on which any of the above enumerated
articles shall be placed, as aforesaid, every
such person so oftendingshall forfeit and pay
one dollar, and the further sum of one dol-
lar for each and every day the same shall be
suffered so to remain, except the article of
firewood, vvhjch mny remain for forty-eight
hours, on such street, lane, or alley, and
no longer. And if any person or persons,
shall in any manner whatever incommode
or obttruct -any of the footways of the
streets, lanes, ojf alleys of the said city or
the gutters thereof, except in the immediate
act of moving or removing merchandize or
any other thing in the way of their trade, or
business, or for the use of their families
excepting ffour and spirituous liquors, and
such other articles as are to be inspected or
guaged under the ordinances of this corpo-
ration, and goods exposed by auctioneers for
public sale ; such goods or articles, however,
to be arranged on the pavement so as not
to obstruct the passage of said footways
from the. stone pavement, to his, her or
their house, store, celler, or backyard,
or from his her or their house, store, cellar
or backyard, to the stone pavement, e-
very person or persons, so pffending,
shall forfeit and pay the sum of one
dollar. And if any person or persons,
shall set or place any goods, wares or mer-
chandize, by way of exposing them to sale,
in any street, lane or alley in this city, to
project more than twelve inches from the
wall of his her, or their house or store,
every such person shall pay afine of one dol-
lar ; And no person shall place or wheel
any wheelbarrow along any of the footways
of the streets, lanes or alleys of the city,
under the penalty of one dollar, provided,
that nothing in this clause shall be constru-
ed to prevent any person from using the said
wheelbarrow in removing any articles of
merchandize, or materials necessary for
building or family use, across the said foot
ways : And it shall and may be lawful to
and for any person employed in building
or repairing any house, to occupy one-third
part of any street', lane, or alley of the said
city, clear of the footways in front of any
lot on which such buildings are erecting or
repairs making with the materials necessarily
used in making such buildings or repairs,
until the same be covered or repaired and
sixty days thereafter, and no longer, under
penalty of forfeiting one dollar for each and
every day the same shall be suffered so to re-
main thereafter, also to use and occupy one
third part of such street, lane or alley in
front of such lot, with plaistcring mortar,
and other materials necessary for plaistcring
such house or-building for ninety.daysand no
longer, under penalty of one dollar for each
and every day the same shall be suffered so
to remain thereafter.
VI. And be it enacted and ordained,
That any owner or owners, consignee or
other persons, bringing to market, or hav-
ing any salted provisions which shall or may
be condemned by the inspector thereof as
unsound, shall remove the same three miles
or upwards from the said city, or to such
place as may be approved of by the mayor
or a commission of health, within six days
after condemnation, under the penalty of
two dollars for each and every barrel not re-
moved as aforesaid, and as often as it shall
appear to the mayor, from the report of the
said inspector, or from the information of
any inhabitant of the said city, that such
salted provisions ought to be removed in a
less time than six days, he shall be author-
ized to order the same to bs immediately re-
moved Jo the distance aforesaid, and any

with such order, shall forfeit and pay two
dollars for every.four hours, for each and
every barrel which shall not be removed as
aforesaid.
VII. And be it enacted and ordained,
That if any person or persons shall cast
discharge, throw or cause to flow into any
of the streets, lanes or alleys of the city of
Baltimore, or precincts thereof, any foul or
nauseous liquor or offensive matter, or shall
,keep, collect, use or suffer to remain
on hip, her or their premises, any such
nauseous liquor or offensive matter, so as to
annoy any of the inhabitants thereof, he,
she or they1 so offending, shall forfeit and
pay for every such offence, a sum not ex-
ceeding )five dollars, and a further sum not
exceeding five (dollars, for each and every-
day the same sljall so remain thereafter:
Villi, And be it enacted Sf ordained, That
if any person or persons having a hog or hogs
in a sty, shall keep the same in such man-
ner, that the stench and tilth thereof shall
become offensive to, and annoy any neigh-
bor or other person, the person or persons so
keeping hij, her or their hog or hogs as afore-
said, shall forfeit and pay for every such of-
fence one dollar, and the farther sum of one
dollar for each and every day the same shall
be suffered so to remain.
IX. And be it enacted and ordained, That
no person or persons shall cast, carry, draw
out, or suffer to lay any dead horse, or other
dead carcase, or any excrement or filth from
vaults, privies or necessary houses, in any
part of the city, precincts or harbor of Bal-
timore, except the same be buried in such
manner as effectually to prevent, any offen-
sive smell, under the penalty of twenty dol-
lar; i r each and every such offence, toge-
getlier with the expense of removing the
same.
X. And be it enacted and ordained, That
the owner or owners of every cart, waggon
or other carriage, employed in removing or
Carrying any sand, dirt, gravel, loam, earth,
manure, filth, stone, bricks or coal, over
any of the streets, lanes or alleys of the
said city, shall have and keep the same in
such tight and secure condition, as that
such sand, dirt, gravel, loam, earth, ma-
nure, filth, stone, bricks or coal, shall not
be scattered, or suffered to fall on any of the
streets, lanes or alleys aforesaid, under the
penalty of one dollar.
XI. And be it enacted and ordained, That
if any person shall open, or clean any vault
or privy, or cause the same to be opened or
cleansed, between the first day of June and
the first of October, without permission of
a commissioner of health, every person so
offending shall forfeit and pay twenty dol-
lars.
XII. And be it enacted and ordair.ed,
That if any person or persons, shall sell or
expose for sale any oysters in shells, between
the first day of June and the first day of
September, every person or persons so of-
fending, shall forfeit and pay twenty dol-
lars.
XIII. And be it enacted and ordained,
That if any person shall clean,' scale or wash
any fish, meat, clothes, or. any other mat-
ter, article or thing, which may be liable to
create a nuisance, or fender the street, lane
or alley, near any of the public pumps m
the city of Baltimore, foul and unclean ;
every person so offending shall forfeit and
pay a sum not exceeding live dollars.
XIV. And be it en. u'.cJ'atdordatned, That
if any blacksmith or other person, shall, after
the'first day of March, one thousand eight
hundred and eigut, cause any horse, mare
or gelding, to stand in ary of the streets,
lanes, or alleys, within the built parts of this
city, whilst he is shoeing, or preparing to
shoe such horse, mare or gelding, or shall
make any fire in any street, lane or alley, to
hoop wheels, or for any other purpose, eve-
ry such blacksmith, or other person, shall
forfeit and pay a sum not exeseding five dol-
lars.
XV. And be .it enacted and ordained,
That if any person or persons shall set up
any pent house, shed, or wooden awning, in
any of the streets, lanes or alleys of this
city, or shall set up or fix an awning of can-
vas or other linen, the railings of whicli
shall not be at least six. feet four inches in
height from the lower side thereof to the
pavement under it, or shall set up or sus-
pend over, or into any of the streets, lanes,
or alleys of the city of Baltimore, for any-
greater distance than tweive inches, any
sign post, sign, figure, or device what-
ever, every person offending in either case
shall forfeit and pay the sum of five dollars,
and one dollar for each and every day the
same shall so remain thereafter : Provided
nevertheless) that Inn-keepers, by permis-
sion of the mayor, are excepted from the
penalties of this clause, so far as respects
signs and sign posts. And all buildings
hereafter to be erected within this city,
which may have cellars, shall haye the
cheeks and doors thereof regulated, so that
they shall not have a greater descent or
grade than one inch, and one half inch for
each fqot in length, extending from the
house or building ; and if any person shall
refuse and neglect to conform herein, he
shall forfeit and pay the sum of five dollar*,
and one dollar for every day thereafter, un-
til the aforesaid regulation is conformed
unto.
XVI. And be it enacted and ordained,
That if any person or persons shall wilfully
break, pull down, hurt or destroy any tree
or trees wdiich are now or may hereafter be
planted near the kerb or gutter of any of
the streets, lanes or alleys in the city of Bal-
timore, such person or persons so offending,
shall forfeit and pay five dollars for every
such offence : Provided always^ That no-
thing herein contained shall be so construed
as to prevent the city commissioners from
removing any tree or trees which they may
deem so situated as to obstruct the carriage
or foot-ways, or injure any of the public
pumps, or any proprietor of a1 lot or lqts
from cutting down any tree or trees in front
of their own lots or any part thereof.
XVII. And be it enacted and ordained,
That no wooden dwelling house, shop, sta-
ble, nor^ any other wooden building (except-
ing fire engine houses) shall be hereafter
erected within that pait of the city of Bal-
timore which lies west of Jones's falls and
north of Barre-street ; and if any person or
persons shall erect or build or cause to be
erected and built, any wooden dwelling
house, shop, stable or any other wood-
en building whatsoever (excepting fire
engine houses) up n any lot of ground with-
in the limits afore said, he, she or they shall
forfeit and pay one hurtthi : the
further sum of twenty dollars to\ each and
every month thereafter, \ until tlie same be
pulled down and removed ; and each and
every person who shall oi* may be employed
in the building or creeling of any such
wooden building, shall forfeit and pay the''
sum of one dollar each and every day he
may be so employed ; and no person or
persons shall remove any wooden building;
upon any lot or parcel of ground within ther'
aforesaid limits, or from any part of a lot
within the aforesaid limits, to any other part
thereof, without the approbation of the
mayor, and the consent of the owners of"
the adjoining lots first had and obtained,
under the penalty of fifty dollars, and ten
dollars for each and every month thereafter,
until the same,! be removed out of the said
limits, or pulled down : Pro-uiJcd, That
so much of this section as extends beyond
the provisions of the former ordinance, the
limits within which wooden buildings shall
not be erected, shall not go into operation
«r have effect until the first day of Septem-
ber next.
XVIII. And be it enacted and ordained.
That if any person or persons shall wilful-
ly stop up or obstruct the passage of the \va-
ter of any common sewer, made, or which
hereafter may be made ; he, she or they so
offending shall forfeit and pay the sum of one
hundred dollars for every such offence.
XIX. And be it enacted and ordained. That
no carter or other person except the superin-
teudant of the streets of the city for public
purposes, shall dig, remove, or carry away
from or out of any of the unpaved streets,
lanes, or alleys of the said city, any dirt,
earth, sand, or gravel, without a special li-
cence first had and obtained from the city
commissioners, with the approbation of the
mayor fur that purpose, specifying the time
when, and place from which the same is to
be removed, under toe penalty of one del- '
lar for every load of dirt, earth, sand or gra-
vel so removed.
XX. And belt enacted and ordained. That
no person or persons, shall make, dig, or
throw up any ditch, drain, trench, gutter,
guily or canal, in, through or across any
of the streets, ' lanes, or alleys of the
said pity, so as to obstruct the passage there-
of, with ut a special licence and permissi-

fore granted by the ordinance entitled an or-
dinance to encourage the introduction of
water into the city of Baltimore) under the
penalty of ten dollars, and the like sum
weekly, until the same be removed or per-
mission given as aforesaid.
XXI. And m it enacted and ordained.
That the mayor may be and he is hereby au-
thorised and empowered to grant licences to_
so many poor persons as to him may appear
proper, to permit them to keep tables or
basket* on the footways or across the gutters
of the streets of the city with the consent of -
tlie occupiers of the houses before which
such table? or baskets may be placed, for
the purpose of exposing to sale fruit, cakes,
nuts and such other articles as have hereto-
fore been customary for persons of that des-
cription to sell, and any person keeping
such table without such licence shall for-
feit and pay one dollar for every day the
table maybe so ki.pt.
XXII And be it enacted and ordained.
That full power and authority is hereby
granted to tine mayor to remit so much of
that part of any fine which belongs to the city
ss to him shall seem just and reasonable,
provided always, that nothing in this secti-
on shall be construed to extend to casc3
where the fine imposed exceeds twenty dol-
lars, or to the costs of prosecution in any
case; and all fines herein imposcdshallbe re-
covered with costs, and when recovered
shall beappropriated as Follows, to wit, one-
half to the informer, and the other half for
the use of the city.

BY THIS DAY'S MAILS.
BOSTON, March in.
The last London papers state, that not
only the regular men in all the royal navy-
yards arc ordered to work double tides, but
tla.t fresh gangs of carpenters are sent to all
the merchants' yards ; and a great exertion
was making throughout the kingdom, to
equip tor sea every kind of vessel calculated
to carry troops ; and that it was expected
attempts would be made on various and dis-
tinct quarters of France, while the French
had so great an army in Prussia and
Poland ; and so many Prussian priso-
ners in France. The French troops which
had passed the Order up to December 3 2
last, amounted to 280,000 men.
Lord Hutchinson, who commanded tlie
British army in Egypt, is at the H. Q, of
the Russian army, in Poland, to see that
it amounts to the number stipulated by tiea-
ty.
UNCOMMON ACCIDENT.
The following particulars are mostly .ex-
tracted from a report of survey of three per-
sons, on oath, appointed to ascertain the
fact :—
