| SUPPLEMENT TO THE FEDERAL GAZETTE. MON-D AY, APRIL 20, 1.8.07. By Authority. ¦ AN ORDINANCE JTor trie safe-keeping of gunpowder within the city of Baltimore, and the precincts thereof. I. T$B it enacted and ordained by the Mayor and City Council of Baltimore, Tiiat no per- son or persons shall keep or have in his, her or their possession, in any house, building or cellar, within the limits of the city of Baltimore or precincts thereof, any quantity of gunpowder, exceeding two quarter-casks, (•which shall he well secured in four tin cannisters, each of which to contain not more than fourteen pounds weight) except in the public magazine used for the recep- tion of the same, under the penalty of twen- ty dollars for each and every cask. II. And be it enacted and ordained, That if any gunpowder, so deposited in the ma- gazine aforesaid, be intended for exportation, it shall .not be delivered on board of the vessel intended to export the same, (over a.*l above the quantity of two quarter-casks as aforesaid,) while the said ship or vessel remains at any wharf within the city or the precincts thereof, or within two hundred yards of the same ; but shall be conveyed from the said magazine, well covered arid secured with a sail canvas or cloth over the powder : nor shall it be lawful for any boat or other vessel, used in the carriage and em; barkatio'n of gunpowder, to lie at any wharf within the said city or precincts thereof, or ¦within one hundred yards thereof, (except , at the wharf a-ected at the public magazine aforesaid,) with the said powder on board, tinder the penalty of twenty dollars (breach and every cask, for either And every of the said offences. III. And be it enacted and ordained, That all gunpowder brought to the snid city for sale ov deposit, over and above two quarter- casks as aforesaid, if brought by land, shall be deposited in the public magazine in twelve hours thereafter, and if brought in a ship or other vessel, in forty-eight hours af- ter breaking bulk ; Slid that no ship or other vessel (ships of war only excepted) bringing or importing any gunpowder into the port or harbor of Baltimore, (over and above the quantity necessary for her own consump- tion,) shall approach, lie, anchor or moor nearer to any part of the said city than bwo hundred vards, or when so mooted, shall not discharge, land or deliverthe same (except as before excepted) at any other place with- in the said city or precincts thereof, than at the wharf at the magazine aforesaid, under the penalty of twenty dollars lor each and every cask so discharged, landed or delivered. I;/. And be it enacted amd crn.aincd, Thnt no person or persons shall cany or con- vey in any boat, dray or other carriage, Or in any other manner, any quantity of gun powder in or through the city or precincts of Baltimore, until the same shall be firit secured in a good bag or bags, or be cover- ed with a Bale or other cloth under and around it, so as effectually to prevent the same from scattering or shifting out, under the penalty of ten dollars for every cask or barrel. V. And be it enacted and ordr.ined That the mayor, or any justice of the peace for the c unty of Baltimore is hereby authorised, as often as he shall be informed upon oath of probable cause to suspect any person or per- sons of concealing or keeping within the said city or precincts thereof, any quantity of gun powder, over and above two quar- ter casks as aforesaid, to issue a search war- rant to examine into the truth of such alle- gation or suspicion, and search any place whatever therein. VI. And be it enacted and ordained, That a superintendant or keeper of such magazine be appointed, whose duty it shall be to at- tend the said magazine every day (Sundays (excepted) from the hours often in the morn- ing until four in the afternoon, and receive all g«n powder delivered to be stored in the said magazine, and give a receipt for the same, mentioning the marks thereof ; pnd he shall receive the following storage for all s?un pc-vder delivered at the said magazine, to wit, tor every barrel twelve cents per month, for every half barrel ten cents per month, and for every quarter cask eight cents per month ; and he shall receive for all gun-powder manufactured within the state of Maryland, and all gun-pow- der which may' be the property of the United States half the storage in the proportions above mentioned ; and it shall be the duty of the superintendant to col. lect the storage on all gun powder stored in the said magazine, and in case the said pow- der so stored as aforesaid, shall remain in the said magazine for twelve months and upwards, on which the said storage shall not have been paid, the mayor may, -after giving public notice for that purpose sell the same, or such parts thereof at public sale, as in his judgment may be sufficient to discharge the amount thereof. VII. And be it enacted and ordained, That the said superintendant shall enter in a book i to be provided for that pupose, the quanti- ty of all gunpowder stored in the said ma- gazine, and by whom stored, and shall on receiving the same, credit the person Storing tin- said powder, with the quantity thereof, and when delivered shall charge the same, and so in like manner for all transfers ; and shall once in every three months make re- turns to the mayor on oath, of all powder stored in the said magazine, and of all mo- nies received by him on account of storage, and paythe Same to the register ; and it shall \ be duty of the said superintendant o.oee ¦very month at leas; mse all the pow- der in the magazine _¦;..:._ aid to be turned | upside down. VIII. And be it enacted and ord.- That the superintendant shall be answerable and accountable to the owners of all gun- powder so stored for the same, unless in- jured or destroyed from any providential or unavoidable accident ; and he shall before he enters upon the duties of his office, give bond with sufficient security, to be approv- ed of by the mayor, to the mayor ami city council of Baltimore, in the sum of two thousand dollars for the faithful discharge of all and every duty directed and required by this ordinance : and snail have and re- ceive the sum of five hundred dollars per annum as a compensation for his services, and all fines and forfeitures incurred under this ordinance shall be appropriated the one half to .the informer and the other half to the use of the city. . THOROWGOOD SMITH, Mayor of the city of Baltimore. AN ORDINANCE For the sinking ot wells, and erecting and repairing pumps in the city of Baltimore. I. Be it enacted and ordained by the Mayor and City Council of Baltimore, That the su- perintendants of the streets shall be super- intendants of all pumps and wells in the ci- ty of Baiti-more, in their respective districts, and shall receive such additional compensa- tion as shall be by law annually appropriat- ed for that purpose. . II. And be it enacted and ordained, That whenever any pumps shall require repairs, or the inhabitants of any neighborhood de- sire a well to be sunk, or any other duty be re.mired of the superintendant which this ¦ ordinance declares he shall perform, the ex- pence of which may amount to fifteen dol- lars or upwards ; and four or more persons, owners of -houses or lots, and interested therein, shall make application to the super- intendant of the district, in writing, express- ing the repairs wanted, and describing the place where the pump stands which needs repairs, or the neighborhood or street where a new well is required, the' superintendant shall attend to the said application so given, within twenty-four hours; and the said su- perintendant shall call upon the superin- tendent of the other district to assist him in levying the tax on the owners of houses and lots in the vicinity of such well or pump to defray the expence thereof : and such snperinteudantij shall lay a tax on all the assessable property that shall appear to them will be benefited by the erecting of su-h pump or alteration in said well as aforesaid, with such a gum as will in their pinion be just and equalin proportion to thebenefit the said property will receive from such pump or alteration of the well aforesaid, and he shall make or cause to be made out, a cor- rect list of the names of the persons who are liable to pay the pnmp tax, and the a- mount to be paid by each person : and they are hereby directed to deliver to the citycol- lector a duplicate of such amount under their hands and seals with directions for collecting the said tax, nevertheless, correct- ing any mistakes ; and the collector shall immediately collect the same, (adding there, to such commission as may be by law allow, ed him for the collection thereof) by dis- tress or otherwise, giving thirty days notice agreeably t<» law, previous to such distress and pay oveUheamouutthereoftothe register; and the superintendant of the district where- in such pump may be erected, or such al- teration or addition to any well ot pump maybe made, is hereby authorised to draw on the register for the amount of the tax, in anticipation of the collection thereof, and to apply the same to the erecting or al- tering the individual pump or well, as the case may be, where the tax is directed to be collected ; and all wells when complet. ed shall be at least five feet in diameter, clear of the walling. III. And be it enacted and ordained, That if any person shall think himself aggrieved by the tax herein directed to be laid, he may within five days after being furnished with his account, appeal in writing to the mayor, who is hereby authorised and directed to no- minate and appoint three persons of integrity and ability, not interested or related to the parties, to examine the said assessment or tax, and either alter or confirm the same, as they or any two of them shall in their conciences determine, according to equity, and shall return the same to the mayor in writing, and their decision shall be final and conclusive on all parties interested : and each of the persons so appointed, shall be entitled to one dollar for their attendance to examine the tax or assessment as afore- said, to be paid by the person or persons appealing for that purpose, in case the first tax or assessment should be confirmed, other- wise to be paid by the superintendant of the district, and be by him charged in the ex- pence of erecting the pump or altering the well, as the case may be, and levied and collected in the same manner as the other charges thereof. IV. And be it enacted and ordained, That the superintendant of each district is hereby authorised to draw on the register for such sums as may be necessary to keep the pumps in their respective districts in constant re- pair : Provided, 1 hat no greater sum than shall he annually appropriated for that pur- pose, shall oe expended in either district in any one year, for repairs, the expence whereof is borne by the corporation -, and the superintendant:- slivrtl oi.ee in every three months render to the mayor a just and true account of alland every sum and sums oi' mo» 1 aey by them expended in repairing pumps, with vouchers and receipts for the same. V. And he it enacted and ordained, That if any person or persons shall maliciously, "wilfully or wantonly break or carry away the handle, or obstruct any pump standing in the streets, lanes or alleys of the said city, or otherwise damage or injure the same, every person so offending, or aiding, or as- sisting in such offence, shall forfeit and pay, for eveiy such offence, a sum not exceeding twenty dollars. THOROWGOOD SMITH, Mayor of the City of Baltimore. AN ORDINANCE, ¦ To preserve the navigation of the harbor of Baltimore, and to provide for the exer- cise of the powers vested in the port-war- dens by act of assembly. I. BE i: enacted and ordained by the mayor and city council of Baltimore, That no person shall extend, erect or fill in a wharf on the west side of the basin, beyond the fine pre- scribed by the act of assembly passed at No- vember session, 1796, entitled, an act per- mitting the proprietors of lots binding on the water, at the west end of the basin, in Baltimore-town, to extend and improve the same. And no person shall extend, erect or fill in a wharf in any other part of the port or harbor of Baltimore, beyond the permissions heretofore granted, unless such person shall apply to and obtain a resolu- tion or ordinance of the corporation, author- ising him or her so to do. And any per- son offending in either case aforesaid, shall be subject to the penalty prescribed in the ninth section of an act of the general as- sembly of Maryland, passed at April session, 1783, entitled, an act appointing wardens for the port of Baltimore-town, inBaltimore county. II. And be it enacted and ordained, That the mayor and city commissioners .shall take under their direction the machines used by this corporation for the deepening of the har- bor oi Baltimore ; and under their superm- tendanoe a channel of two hundred lectin width shall be deepened within the follow- ing limits, to, wit : Beginning for the north line thereof at a point fifty feet south of Pratt-street, and the like distance east of Light-street ; and from that point passing fifty feet soulh oi the south-west corners of Bowly's, South-street and Commerce-street wharves; and thence passing fifty feet of the south-east corners of Dugan's wharf and M'Eldeiry's wharf; and thence passing- fifty feet south of the south-east corners of Chase's wharf, and thence to a point at the distance of three hundred feet south from Patterson's'vvhmf, on Fell's-Poiut, upon a direct extension of the west line ot raid wharf; thence returning with lines parallel le-those above desciibed, and distant 1!; -c- from two hundred tect. And if any person shall wilfully obstruct the said channel, or remove any slake or buoy placed to mark out the same, or shall run foul of or in any man- ner hinder the working of the mud machine, or any scow or other vessel employed in dis- charging mud raised out of the channel, he shall forfeit and pay, for every such offence, a sum not exceeding twenty dollars ; and moreover shall be liable to pay any damages that may be sustained.-thereby. III. And be it enacted and ordained, That all wharves made out into the basin or har- bor, in front of any street or part of a street, and which street was heretofore laid out in the plan of the town as extending to the water, are hereby, as has been heretofore, declared public wharves, and subject ta the wharfage imposed and laid by the ordinan- ces of this city ; except where they have been made out in virtue of a special act of assembly, and the wharfage secured to the individual making the same. IV. And be it enacted and ordained. That if any person shall cast or throw any ballast, dirt, oyster-shells or filth, into the water, in any part of the basin or harbor of the port of Baltimore, above Whetstone point, or on the shore of the said basin or harbor, below I high water mark, unless for the marking a wharf after permission obtained for that pur- pose, and which wharf shall be well and sufficiently enclosed and secured, so as to prevent injury to the navigation, such per- son, so offending, shall forfeit and pay, for every such offence, a sum not exceeding twenty dollars. V. And be it enacted and ordained, That the owners of private wharves shall be obliged to keep them so in repair, as to prevent injury to the navigation ; and that whenever any owner of a wharf shall suffer it to be out of repair, so that dirt or filth may wash into the harbor, the mayor shall have power and authority to summon said owner before him, and to fix a reasonable time not exceeding one month, for secur- ing said wharf, so as to prevent injury to the navigation ; and in case the owner of any wharf as aforesaid, shall refuse or he- jdect to appear when summoned by the mayor, or to make the necessary repairs, as aforesaid, he or they shall forfeit and pay a. sum not exceeding ten dollars per week, during such neglect or refusal. VI. And be it enacted and ordained, That all money arising to the city from the wharf- age of the public wharves or docks of this city, or so much thereof as may be neces- sary, is hereby specifically appropriated to the improvement of the particular wharves and docks, from which the same may be collected, under the direction of the city- commissioners, with the approbation of the mayor. VII. And be it enacted and ordained, That a harbor-master be annually appoint- ed ( ho shall before he enters upon the execution of his duties, give bond, with security, to be approved of by the mayor and citycouncil of Baltimore, in the sum of two thousand dollars, that he will well and faithfully discharge the several duties of his office) whose duty it shall be to at- tend to the preservation of the navigation and harbor, the mooring and stationing of vessels, to collect all wharfages of vessels, and all monies which may be due this cor- poration, for mud raised from the basin, and all fines and forfeitures arising under this or any other ordinance or act relating to the navigation or harbor, the collection of which is not otherwise provided for, and pay the same to the register for the use of the city ; and he shall superintend under the direction of the mayor and city com- missioners, the working of the mud ma- chine, and the harbor-Master is hereby au- thorised to appoint one or mere deputies, to be approved of by the mayor, to assist him in the execution of his office, for whose conduct he shall be responsible. VIII. And be it enacted and ordained, That the following wharfages shall be col- lected on all vessels, which may lie at any public wharf, to wit : on all sea-vessels, at the rate of one dollar for every day they shall so remain ; and on all other vessels, at the rate of one cent per ton, for every day they shall remain at any of the wharves aforesaid, and ali vessels lying in the second tier shall pay half wharfage, which said wharfages shall be collected daily ; and the following wharfages shall be collected for o p the articles hereafter enumerated, landed at any public wharf within the city, to wit : For every cord of wood six cents ; for eve- ry bundled feet of scantling, or plank, two cents ; fir every thousand staves, heading, or shingles, twelve and a-half cents; for every hundred bushels of coal or salt, twelve and a half cents ; for every hundred posts or rails, twenty.five cents ; for every hundred cedar bolts, twelve and a half cents ; for every thousand hoop poles, twelve and a half cents ; for every thou- sand laths, two cents ; for every thousand garden pairs, six cents ; and for every ton of gypsum or plaister, six cents ; and if any person or persons avfnikg any ol the foregoing enumerated articles, shall suf- fer the same to remain on any of public larding places lo«ger than (wen- ty-&n*t l>ouro, 0110K owner or owners shall forfeit for every such offence, double the rate of wharfage" upon the said arti- cles, for every twenty-four hours the same or any part thereof shall so remain on the said landing places ; except plank and scantling, which may so remain for four days after ; the landing thereof, and after that time shall be subject to double wharfage as aforsaid ; and every barrel of tar, pitch, tur- pentine, beef pork and fish after having re- mained twenty four hours on any of the public wharves within the city ot Baltimore, shall pay two cents for each and every barrel which shall so remain, and at the same rate for every twenty-four hours thereafter ; and in all cases where firewood or lumber is landed as aforesaid, it shall be optional in the wood corder or inspector of lumber to receive the wharfage on the firewood or lum- ber, or on the vessel, but not on both at the same time ; and if any person or persons shall obstruct the harbor master, or other per- son appointed to collect the wharfage afore- said, in the ascertaining the tonnage of any vessel, or in the collecting of the wharfages hereby imposed, he or they shall forfeit and pay five dollars for every offence ; and the harbor master shall once in every mom h account for on oath and pay oxer to the Re- gister all money by him received, in virtue of this ordinance. IX. And be it enacted and ordained, That it shall not be lawful for any person to heave down or clean a vessel, at any public wharf within any part of the basin or harbor of the port,of Baltimore, or to land or put on shore, on any of the said wharves, any stone, bricks, ballast, oystershells, dirt or filth, or to make any fires thereon, without the per- mission of the harbor master, and if anv such person shall be guilty of any of the offences aforesaid, such person shall for- feit and pay a sum not exceeding twen- ty dollars, and if any person or persons shall leave hogsheads or tierces, on any pub- lic wharf, within the city of Baltimore, and shall suffer the same to remain longer than twenty-four hcurs on said wharf, each and everv person so offending, shall forfeit and pay six cents for each and every pipe or hogshead, and three cents for each and every tierce, for every twenty-four hours they shall remain on the said wharf thereafter. X. And b1' it enacted and ordained, That if the master or skipper of any vessel shall refuse to haul off or remove from any public wharf, when ordered by the harbor master, or if the vessel be a wood flat, by any one the wood corders, he shall forfeit and pay one dollar for each and every hour he may remain thereafter, unless the weather or tide should prevent him from so doing ; and it shall be the duty of every master or skipper of any vessel, to rig in his jibboom on coining to, at any public wharf, and he, or they offending herein, after being so or- dered by the harbor, master shall forfeit »ud pay for each and every offence five dollars.
