AN ORDINANCE To license and regulate Auctions within the city of Baltimore and the precincts thereof. I. BE it enacted and ordained by the m<>/> or and city council of Baltimore, That no per- son or persons shall exercise the trade or business of an auctioneer, by selling of any property, real or peraonal, by any mode of sale whereby the best or highest bidder is deemed the purchaser, within the city of Baltimore or the precincts thereof, unless he shall have previously obtained from the mayor a license under the seal ot the corpo- ration, under the penalty of five hundred dollars forevery such sale: Provided, That no- thing iuthisurdmaacc containcdshallextend to any sale by anction of property, realor per- son d, made pursuant to or in execution of any order, decree sentence or judgment of any court of the .United States, or of aither of them, or made in virtue of any distress for rent or oilier cause for which a distress is allowed by law, or made by or on behalf of executors or administrators, as such. And the mayor shall, upon the application of any citizen or citizens ot liakiitidre, or the precincts thereof, complying with the con- ditions hereinafter mentioned, grant a licence for the term of one year to exercise the trade or busincsr; of an auctioneer ; arid for said .license the person or persons ob- taining the same shall pay or cause to be .mji, for the use of the city, the stun of seven hundred and fifty dollars. And no such license shall be grant- ed or renewed, until the perr.on or persons applying for the same shall have given bond to the mayor and city council of Baltimore, I with sureties to the satisfaction of the mayor, in the penal sum of thirty thousand dollars, i cuirent money, with condition that he or they bhall duly pay and satisfy all just claims that may be against him or them, as auc- tioneer or aoctioneers, and will faithfully execute thcofficeanel employment of an auc- tioned and in all things well and faithfully perform the several duties required by this ordinance. II. And b» it enacted and ordained, That no auctioneer or auctioneers, licensed as a- faresatd, shall demand or receive from any person, directly or indirectly, for (vis or. their services, a commission exceeding the rate of two dollars for every hundred dollars oi. the purchase-money arising by the sale at auc- tion, of any property, teal or per -aJ; .*>. special licence for the term of one year, to exercise the trade or buslucSj ol m\ auction- eer, by selling of books, maps or pi; auction, and the person or persons obtaining such license shall pay therefor fifty ddans ; and no sach license shali be granted or re- newer] until the person or persons applying for hie same shall have given bond to the mavor and city council of Baltimore, with sureties to the satisfaction of the mayor, in the penal sum of thru: thousand dollars current money, with condition that be or they shall duly pay and satisfy all Just claims that may be against him or them as aucti- oneer or auctioneers, and will faithfully ex- ecute the office and employment alor, ai I , and no auctioneer, for the purpose ^foresaid, shall demand and receive from atiy person, directly or indirectly, for his or their ser- vices, a commission exceeding the rate of ten dollars for every hundred dollars of the purchase money From such sales, exclusive of all duties. V. And he it enacted and ordahied, That any person or persons desiroir; ot pursuing the business of an auctioneer of household furniture and wearing apparel, which hath been previous to the salt- thereof in actual use, may apply to the mayor for special li- cense for that purpose ; and the mayor shall tkrenpo?i grant such special license, restrict- ing such sales to be made by day-light only, upon (he terms and conditions aforesaid : provided, that the penal sum of the bond given by such person shall be three thou- sand dollars, and the persons obtaining such license, shall [wy therefor one hundred dollars, and that such auctioneer shall be entitled to receive for his services, a com- mission not exceeding the rate of four dol- lars clear oi all duties, for every hundred dollars of the purchase money arising from each sale ; and tiie auctioneers wdio hold license authoi.sing them to sell any good*, wares and merchandize, may and are hereby authorised to. charge a commission of four per centum clear of all duties, on all house- hold furniture and wearing apparel aforesaid, sold by them ; and upon the sale of books, maps or prints, may charge a commission of ten per centum clear of all duties, any thing contained herein to the contrary not- Withstanding. VI. And be it enacted and ordained, That every" auctioneer shall, out of the monies arising from each and every sale, return and pay to the register for the use of the corpo- ration, at the rate o one dollar for every hundred dollars, on the amount of ail the sales made by him or them, and shall once in every three months, on oath'or affirma- tion, account for, and pay the same to the i 'gister; and to the end, that such accounts may be accurately kept and. rendered, it is hereby made the. duty of every auctioneer to enter fiom day to day, as often as any sale shall be made, in a book to be kept for that purpose, the amount of the respec- tive sales made by him or them, which book shall upon application be submitted for ex- amination to the mayor, and for every re- fusal to comply with such request, he, she *r they shall forfeit and pay the sum of live thousand dohars. VII. And be it enacted and ordained, That if any person shall sustain any injury or da- mage trom any act or default of an auctio- neer contrary to the tenor of his obligation given as aforesaid, then and in such case such person shall have right to institute a suit, or suits, at law or in equity, upon the obligations given as aforsaid, as the case may require ; in the name of the mayor and city council of Baltimore, in the proper court or courts, and the same to prosecute to the final endtriereof for the use and bene- fit of such persons, in which suits the per- son or persons injured as aforesaid, shall be entitled to obtain and recover a verdict and judgment, to the amount of the injury or da- mage he shall make appear to havebeei^byhtm sustained, or suite red as aforesaid.
