to.a-'y deny ; and .-ay that neitStSr tli? la* or usage of independent nations recognize such a principle. It is, indeed, we understand, customary for the commanders of men of war on the high seas and on foreign stations, as an act of courterey, to surrender deserters from each other. But in this case the act of desertion is direct from one vessel to the other ; and the delivery is a matter of favor not of right. Let us then hear no more of this most absurd of all absurd pretensions. However, the Englishman, whose habitual perversion 6f mind has accustomed him to measure right by force, may rave in the delirium of Lis passions ; let us look upon that American as a promising candidate for bedlam, who hroaches such opinions; and, particularly, let our eyes be hxed upon him in times like these. [Intelligencer.] ¦____¦_._____ - . , , • FEDERAL GAZETTE. TUESDAY, JULY28. From our Correspondent. u New York, (Sundry) July 26. JlTr. tfouwt, Had the writer of a certain article in your paper yesterday, called on a justice of the peace, it mi,.;lit have been ascertained whe- ther any of the blacks detained at the house in the south-west end of the city, were sto- len. But, -whether in consequence of the writer** mi,taken zeal or not, the persons have left town with the blacks, all ot whom, the landlord says, were b 't in this town o'r on the Eastern Shore, and in part confined in the county jail until this morning. One of the Justices. I'ront the Virginia Gazette. Mr, Davis, A publication made in your paper by Mr. Beverly purporting to be an account of some occurrences which took place respect- ing general Wilkinson, before the strand jury, which lately attended the United States court at Richmond; doth certainly contain some errors. They will be rectified as far as my name is concerned by the pub- lication of this note. There was no motion made to present general Wilkinson, fat high treason, that I remember ; there certainly was *o vote ta- ken on such a question. A motion was made to present genera) Wilkinson for mis- prision Of treason. The jury divided, seven for, nine against the presentment. I was with the m-A-irity. A motion was also made to present the pen end for a violation of the laws and co'n- stifnti n of the United States I do not re- member how the jury divided on this ques- tion, but I was with the majority. I should not perhaps have tr ubled you with this address, ha 1 it n< t become neces- sary to correct another mistake. I am informed that several gentlemen in Richmond have said, and perhaps certified under their hands, that they received an ac- count from me, corresponding uith the statement made by Mr. Beverly. Theae de derations and certificates if any such trier- be, must be due to a misunderstanding or Mfsappl'Oation of the terms of my conversa- tion.—I never did state to anv person that tiie grand jury were divided on a motion to present general Wilkinson for high treason ; or that any uich question was made before them. After the grand jury were discharged, and in course of the next day, sundry gen tlcmen of my acquaintance, at different times and places addressed me to the follow- ing effect.—L' We have heard contradicto- sy accounts of the division of the grand -jury, upon a motion to present general Wil- kinson, (vithout stating for what offence) will you be so good as to give us the correct account ? I answered " I believed the jury i yvere divided, seven for nine against the presentment." The misunderstanding, I suppose must have happened this way.— Those who had heard of Mr. Beverly's Mr. Beverly's- account of a motion to pre- sent f-r High Treason, -which -was not made, connected with it, my answer which could refer to other than the motion to present for | misprision of treason which was made. Or, I if any gentleman addressed me in terms whicin authorised him to regard my answer as applicable lp a question of high treason, I did not attend sufficiently to the terms of , his question, or should certainly have set him right. I can see no motive for wilful ;' misrepresentation of this subject on the part of any. I will suppose none to exist. WILLIAM DANIEL. Jun. Cumberland, 18th July, 1807. From the Democratic Press. I observed in your paper of Monday last a communication, stiled " Vodges tit.Duane," ¦in which the author has endeavored to im- press the public mind with an opinion, that I had been guilty of .-rudeness towards Mrs. Diuine, which is false ; and in answer to which I beg leave to give the following statement of facts. On Saturday last my ( friend major general John Barker, called on | rue, and showed me a most villainous attack ; on his character and reputation in the Aura- j ra, and requested me to wait on the editor, ; col. Wm. Duane, to demand of him an ex ! planalion upon the subject. Agreeably to , J^n: wish of the general, I called at vh>.' book- I see*c of Duane, and oi inquiring Tor h'rti, I was told that he was not at home'. " I call- ed again about two o'clock, and asked the boy if the colonel bad come in. He hesita ted a little, and then answered that he had been in, but would not see me. On colonel Duane's name being mentioned, Mrs. Duane made her appearance, and said that he was so much engaged in consequence of Wil liam's absence, that he refused to see some of his most particular friends. 1 observed then, that possibty the colonel might sup- pose I had come to insult him, as a misun- derstanding had for some time subsited be tween us. ; but, I assured Mr*. Duane, that I had no such intention. She then observed that I might leave my business in writing. I expressed my disinclination to do so ; but desired her to inform him that I would call again. She then referred me to a Mr. Sproul, who had just stept in— During the whole of this conversation, Mrs. Duane did not appear to be at all alarmed, or to have the least idea of the nature of m business I called, for the third time, about 7 o'clock in the evening, and was told that the colonel was in. In about 15 mi- nutes, he made his appearance from the back room, at which instant three persons came in at the front door. As Duane approached I advanced to meet him, addressing him as follows: " Sir, I have a message from Gen. barker, which I wish to deliver in private." He replied, " I will hear no message from you." I attempted to reason with him, but without effect; he flew at me in a furious manner, but rinding he could do nothing with me himself, he oiled the three persons to his assistance, exclaiming " kick the damn'd rascal out of the house." They fell on me like so many villains, and broke my guard, at which rime Duane struck me in the face, and cut me under the eye with a knife, or some small instrument which he bad in his hand when he came out of the back room. During this time I never once attempted to strike Duane, but told him that his house protected him ; that if he daied to come into the street, 1 would give him what he deserved. This the fighting colonel de- clined, by saying I was too big. I observed that I would be the better mark for him, and firesumed thai he knew what I meant; but that he was a cowardly assassin, who would fight no one in an honorable way. He re- plied he would not fight me in any way. Some gentlemen interfered, and intreated me to go ii to Dr. Seybert's to have tne wound dressed, two physicians gave a deci- sive opinion that it was cut with some shar/i instrument, and not with the colonel's knuc- kle, so much talked of. JACOB VODGES. » July 22. From a Philadelphia petper. TO THE FREEMEN Of the state of Pcnsybuania. The subscriber proposes to f mi a com- pany for the purp se of boring land, and collecting those machines in order to find out tiie internal composition, of tiie bowl, of the earth, 011 the Rivers Susquehanna. Juniata, Kinkmenetas and Allegany. Experiments of this kind, are not attend- ed with any considerable expence ; and they give as much knowledge ol the inter- nal structure of the earth, as wiil be obtain ed by 50 times the sa'i'e expence in digging to any considerable depth, and wore expe- ditiously. . • Many valuable Ores, or Minerals. &c. appear in such a rude state a true knowledge of their different value, can only be obtain- ed by experiments. A soil proper for ma- nure, may be judged by the planter—but as matter, they come under the enquiries of the philosopher. Those hints are not in- tended to lament any loss of time, or remis- ness in the pursuit of useful knowledge, but to furnish matter to futuie studies—that while we glory, (as American.-,) in .-hat ve are we may not neglect what we -re to be. It is said, that lands in England, France, &c. have been raised to six times tne value, by the discovery of chalk, coal, &c. In digging a hole to sink a post some time ago, in the state of Delaware, the la- borers threw out with the soil, a line blue powdered earth, resembling indigo ; which, when mixed with oil, was used for paint. The following are the sentiments of Dr. Franklin on the subject, in a letter to a friend some time previous to his death : " The degree of improvement which A- merica is already arrived to, is astonishing ; but 'tis miniature to what she will one day boast of. The bowels of the earth have been only slightly inquired into. The ex- external earth makes no proclamation of the interior stores, but leaves to chance and in- dustry the discover)- of the whole- By a small degree of attention to the order and origin of things, we shall perceive that tho' the surface of the earth produces the neces- saries of life, yet it is from the mine we extract the conveniences thereof. Agricul- ture and manufactures would wither aw ay for want of tools and implements, and com- merce stand still for want of materials. Since so great a potion of cu. enjoyments is drawn from the mine, it is certainly an evidence cf our prudence to inquire and know what onr possessions are. Every man's landed property extends to the sur- face of the earth. Curiosity alone would direct him to examine, tho' not to the bot- tom, at least to a considerable depth. " The propriety and reasonableness of those internal inquiries, are continually pointed out to us by numberless occurrences. Accident is almost every day turning out some new secret from the earth. How of- ten has the plough-share or the spade broken open a treasuie, which for ages, perhaps forever,-had laid just beneath the surface ? Though every estate has not mines of gold or silver, yet it may contain some valuable property," . , Those gentlemen who wish to promote so useful an undeitaking, are requested to call a meeting at the different county towns, some time previous to next November.; af- terwards to apply to the legislatureot Penn- sylvania for a charter. R. S. Characteristic Anecdote of Admiral Berkeley. The honorable admiral Berkeley, thenonly a captain in the British navy, commanded the Marlborough in Lord Howe's memorable engagement on the 4th June. Early on that day he got a scratch in the head, so very slight that a midshipman would have been ashamed to have mentioned it to the stand-, ers-by during such an engagement. The honorable captain, however, thought fit ifo be prevailed ufivn to go down to tiie cock- pit to have care taken of his wound for fear of consequences, leaving the command of the vessel to the eldest lieutenant, who being a poor Hibernian, unfriended by any thing but his own heart & hands, & of course without interest at the admiralty, thought that this was a glorious golden opportunity to make a'dash and recommend himself to promotion by some extraordinary deed dfp: j.vess. . He accordingly lost no time in running up the Marlborough where he thought she would have enough of peppering, and where she soon caught the vigilant eye of the brave Howe, who with his spy-glass perceived her very busily employed in paying her best compliments to three French line of battle ships, one of which r..ked her lore and aft. Astonished and Concerned at her situation, his lordship hastily called to sir Roger Cur- tis his captain, and said, « Why°sir Ro- ger, sir Roger ! what in he name" of Hea- vencan be the matter with the Marlborough ? ' Sir Roger who knew Berkeley, and was keen, satirical, and witty, as well as brave and humane, looked for a moment through his glass at the Mailbon.ugh, and then turn- ing round to lord How drily replied, " /don't know, my lord, but I should imagine from he conduit of the Marlborough that captain Berkeley has been killed."
