Tne court assembled at 12 o'clock. An
- immense concourse of citizens attended to
" ¦witness the proceedings of this. important
trial. .
A few minutes after, Aaron Purr entered,
attended by messrs.Wickham, Martin,F.otts,
Barkers and mr. Alston of South Carolina,
inr i. Randolph entered soon afterwards.

Such as have a I prefixed to their names,
tvere recognized at the former meeting of the
court. Tue rest were not. ¦ Of course,
most of all those, whose names arc placed
after' that of H. Latrobe, haveljgren sub-
poenaed since the adjournmsnt of the court.
Mr- Hay begped leave to mention, that
lie had nothing mere to submit to the court,
this day. It was his de'y to furnish the ac-
cused with a list of the jurors, with their
places of residence ; and also of the ut-
nesscs. But there wc:e many of the wit-
nesses, of whose places of residence he was'
completely ignorant: several had not appear,
ed i many had been merely pointed out to
liim by the A. G. for the United States.—
It was clearly impossible for him to make
out those lisis, before the day after to-uaor-
tarty;
The Chief Justice enquired then to what
day it would be proper to adjourn the c< urt.
Mr. Hay could not positively state, by
what day, he should be able to prepare his
lists.
Mr. Burr observed, that it was not very
probable, he should avail hiuiselt of any
privileges which he might derive, from any
delay which had occurred in the furnishing
him with the list of the jurors $ and there-
fore the court might adjourn itself to any
day, which was convenient to the attorney
For the United States. Neither was it pro-
brobable that be should avail himself of any
objections which might be made to the cor-
rectness of the names of the jurors or their
places of residence, as stated in the list;
unless certain circumstances might occur
after the production of the list, on which
he ought to found objections to it:
A short conversation then ensued npon
the day of adjournment, when Mr. Burr ob-
I served that as such a measure would seem in
some measure to dcpetuiipon his o.'ii consent,

journment, provided it did not extend fur-

Mr. Hay observed that it might be proper

Of course, only two were absant out of the
whole Venire.
Mr. Hay then requested the marshal to
deliver as soon as possible a correct copy of
this list to the opposite counsel.
Mr. Peyton Randolph inquired whether
this «as a proper opportunity for any person
on that pannel to state his objections to the
service.
The Chief Justice replied that it would
be better ro wave any objections, until the
jury were about to be impannelled.
Mr. Hay wished such of the witnesses as
had not appeared before^ to be recognised
as the others had been. And accordingly
Messrs. Duncan", Nevill.M D-.well & Retire
wea' recognised by. the clerk.
The deputy-marshal was then about to
adjourn the court; when Mr. Burr recalled
to the recollection of* the court the motion
which he had made on a former occasion
for a stibpxha duces tecum, addressed to the
president of the United Stales. That mo-
tion had been partly complied with. He
wished to know of the couit, whether it was
not a matter of right for him to obtain a.
sulrpana duces tecum. If it was not, he should
then lay a specific motion before the court.
The Chief Justice did not belieee it to be
the practice in Virginia to obtain such a
mi''poena upon a mere application to the
clerk. The motion must be brought before
the,court itself.
Mr. Hay wonld say nothing on this sub-
ject until he understood the object of the
application. If it was to obtain the letter
which was not formerly furnished, he would
inform the opposite counsel that he had it
now among his papers, and was ready; to
produce it.
Mr. Burr. That is one object of the ap-
plication. Another is to obtain a certain
communication from gen. Eaton to the pre-
sident of the United States, which is men-
tioned in his deposition.
Mr. Hay was not certain .whether he had
that communication; but believed that it was
among his papers, If it was there he would
certainly prooXice it.
Mr. Burr. But if after a search, the gen-
tleman finds that he has not that paper, will
he consent out of court to issue a subpa-na
to the president of the United States under
the qualification I have mentioned r I wish
not at the present exigency, to derange the
affairs of the government, or to demand the
presence of the executive officers at this
place. All that I want is, certain papers.
Mr. Hay could not consent to such a mea-
sure ; he would rather that it should go thro1
the regular process oi the court.
Mr. Burr. Then, sir, I shall move for a
snbfwna duces tecum to the president of the
U S. directinghim to attend with certain
papers. This subpeuna will issue as in the
Former instance. 1 shall furnish the clerk
with a necessary specification of the paper
which I require.
The court was then adjourned till Wed-
nesday, 13 o'clock.

FRIDAY, AUGUST 6.
Schr. Eliza-Ann, Russe!, cleared from
Charleston for Baltimore, 27lh July.
Marke* at Laguira, yth July were glut-
ted with etery kinii.of merchandize ; flour
at 10 dollars. There were in part unsold
700,000 dollars ivorth of American proper-
ty, and getting scarce.
The U. S. brig H met touched at Mal-
ta, in June, and land the British Consul
from Tripoly.
The brig Calisto, of Bath, was at Nevis,
14th July, to sail soon ; 30 hhd^. sugar on
frieght condemned, the rest of her cargo
cleared.
The scll'r Bet"y, capt. Brown, from Bor-
deaux, was boarded on his passage from Bil-
boa, off the Cordovan, by a British frigate
—the officer remained on board near an
hour «-took down the minutes of the Betsy's
rout, &c. and permitted her to proceed.—
I coming out of the Kay came through the
British squadron causing oif the Garonne,
and was not brought too, nor.spoken- by
any of them. By this it appears that this
squadron did not coiisicki' it illicit trade, 01
^ that vessels in ballast, bound from one ene-
my's port to another to take a return csrgo
