Sept. n, in lat. 40, 40, long. 53, saw a WRECK, appeared to be a brig about 180 tons, flush deck, stout waist, fi- gure head, but gone, a round black stern with a yellow mouldingabout 6 inches wide, painted round her stern, her masts wcie gone about 6 feet below the cros-trees, and were hanging along side, as was her bow- sprit and rudder, her foremast had two sup- porters, one on the back side, which came half down the mast, and secured with two seizings, one supporter on the fore part of her main-mast, both masts of bright yellow, her windlass was gone, but both anchors were on herforscastle lashed to her windlass, but there was a belfry and gallows frame standing, and her pumps aft of her main- mast, boom chooks on the taffet rail. They regarded themselves as under his direction. Q^ Were there any other officers apparently under Burr's com- mand ? A. Yes ; col. Tyler was an officer, and Mr. Blannerhasst-tt seemed to be one, hut not to have so much command as col, Tyler. Mr. IVirt. Some of them appeared fit ; but most of them seemed like gentlemen. Mr. Hay presumed that it would not be departing from the pinion of the court, if he asked a, question concerning some trans- action out cf the United States v hiob, might serve to elucidate the state, of the party at the mouth of the Cumberland. Might he not, for instance, inquire w hether the wit- ness had seen any b'xes of arms at Bayoo Pierre ? because it was perfectly fair to in- fer, that if they had not hern subsequently received, they must have been <¦. ith the par- ty at the mouth of Cumberland river. Mr. Burr. No precise inference can be drawrr from that circumstance ; because these arms may have been received int the boats be^ low the line of Tennessee. The Chief Jus- tice thought it a proper question. If the acts attempted to be proved were done in. the United States- evidence might be drawn from anyplace to prove them.
