. FREDERICKSBURG, (Va.) Oct. 21.
Melancholy and Distressing !
On Monday at i.% o'clock, tke house,
formerly belonging to Mrs. Carter, in this
to .11, was discovered to be on fire. Tne
corpse of Mr. William* St^aru, the more
recent proprietor, had n t been sunt to its
.earthly home, when a sick and mourning
family were driven by a new ca'ui. ity, with
the remains of a parent and a husband from
¦the solitude of their sorrows, to weep under
the next hospitable root, over their compli-
cated misfortunes.
The hou,-e was on an eminence, and a
Strong wind from the 11 >rth we^t -dew the
flames into the body of the town. In the
C- urseof a tew hours, three ot the be--t un-
proved squares, with parts of two othe s.
were stripped of all their improvements.
The rapidity of the fiie the h rro's ol its
devastation through h uses big dy combus-
tible from the opetation of the late drought,
the c nsternation that prevailed destroying
concert and presence 01 mind in most of
those who were laboriously active, the in-
competency of the engines t 1 perform their
offices witii lull effect, prevented many of
the suffe ers from saving a great proportion
of thtir moveable property. The upper to-
bacco warehouses, with all the to'oacco
Stored, were consumed. A flake of turning
matter was thrown on the roof of the bank-
hou.e,awhich stood at the distance of two
Streets from the general conflagration ; and
so furious was the progress ol the flame, that
all the books, papers, and money in the
vaults, were of necessity 1 xpos^d., during the
¦whole ot the fire, to its action, but have since
been recovered entire. Happily no human
lite was 1-st.
This awfully afflicting event has bereft
many families, some in disease, st the en-
trance of winter, of their only .shelters, and
of their all. The woes of the comfortless
and of the suffering, which pervades a great
part of Fredericksburg, call aloud for con-
tributions from the opulent. The inhabit-
ants of this town were lately liberal in their
relief to the wretched f Norf. Ik. A plan
has been organised to fu nish the benevo-
lent of the sister towns in Virginia, and of.
the neighboring country, with an opportu-
nity of enjoying that luxury which a pure
bosom feels in giving charily where merit
and distress combine to claim it.
At a meeting of the inhabitant,! of the

said sufferers as may require aid, and to dis-

Tup.sday, October 20
Twelve o'clock. The court has just de-
livered a long and elaborate opinion, in
which it determines, that "it would be im-
proper to commit the accused on the chai'jjl
of treason."
The conclusion of the opinion is as fal-
lows : " I shall commit Aaron Burr and
Herman Bleniierhassett for preparing arid
providing the means for a military expedi-
tion against the territories of a foreign
prince with Whom the United States were at
peace. If those whose province and duty
it is to pros-cute offenders against the laws
of the United States shall be of opinion
that a crime of deeper dye has been com-
mitted, it it not their choice to act in con-
formity with that opinion. Israel Smith is
not proved to have provided or prepared any
means whatever, and therefore J shall not
commit him. If he has really >.ff.-nded
against the laws, he may be prosecuted for
the treason in Kentucky, or for the misde-
meanor in bis own state where, if any
where, his offence has been committed."
Mr. Hay moved to have A. B. and H. B.
committed for trial in the district of Ohio.
From the Evening Post.
On Monday evening last, after the review
of the Baltimore Brigade ot Volunteers, the
theatre was prodigiously crowded in conse-
quence 61' some arrangements the managers
nad made to honor a day so honorable to the
patriotism of our citizens.
After the corn-dy was performed of*' The
Wonder! or, a Woman keeps a Secret," an
entertainment in. honor of the day, called
" The Shirit of Independence" was present-
ed- The following is some account of it:
On the rising of the curtain we beheld
a most beautiful scene, representing in per-
spective, an encampment, and a review of
troops under amis -in the centre of the
stage was a inili'.r.y column, ornamented
with flag;, which suddenly becoming trans-
parent, there appeared the numbers of the
Four regiments reviewed during the day. and
the wiole capped uy the figures ,77ti
Tne effect was like electricity ; the Whole
audience burst out into a tumultuous up-
plau-e, which was n,.t lessened by the Yan-
kee Uocdle of the orchestra.
Mrs. Seymour, dressed in character, then
song, in a very capital style, .'• The Bonny
bold Soldier," which was well received :
she was then foliowed by Mrs. Melmot/i,
who recited an elegant eulogium (her own
composition, as I understand) on the " A-
mcrirr.n IVr.rtiies," in which she was fre-
quently interrupted by the warmest tokens
>f approbation and enthusiasm of the audi-
Slice Of this eulogium, I regret very
much that I have been unable to obtain a
copy.
Then was presented, a " Martial Cotil
Hon," which, except a little good dancing,
had nothing to recommend it.
Mr.'Bobbins succeeded, and sung the fol-
lowing song, with trumpet accompaniments,
written by Mr. John vlills, of the theatre,
£nd set to mtijHC by Mr. Jonu Cole, of this
city, wh\ch met the approbation of all. & was
unaninously encored. It is proper to bserve
that Mr. Bobbins sung it in character of one
of the " Independent tilues," of which corps
he is a member.

Master F. Durang then appeared and per-
formed the manuel exercise, (the Orchestra
in the mean time playing the President's
march) in a most graceful and correct man-
ner—and received unanimous approbation.
Mr. Webster, dressed as one of the
'' First Baltimore Hussars" (that elegant
tr. op commanded by captain Barney) entered
and rave us the following song, in the very
first style, written by a gentleman of this
city, and set to music, by Mr. BLeinagie,
called
Eifst Baltimore Hussar-
Hark I the brazen trumpet's call,
Bids us prepare for wars—
Haste, buckle on your Sabres all,
First Baltimore H'ussars.
'Ti« boner makes the soidierti<*av«,
While cowards skulk afar ;
You'll wear the laurel to the. grave,
First Baltimore Hussar
Maybe who lirst this name defiles,
Or would its honor mar,
Be laiel by you on funeral piles,
First Baltimore Hussar.
Come armed phalanx, we are one,
-Advance Joves thundering car,
Remember you are freedom's son,
First Baltimore Hus
Our country calls, we must away,
And bear in heart > '"'t fair ;
Should we reiurn they'll greeting say

Hark ! the second trumpet's call,

When Mr. Webster had ceased to astonish
the audience with a display of his great vo-
cal powers in the preceding song, a trans-
parency was let down from the top of the
theatre representing Wisdom, bearing in
her hands the the bust of Jefferson, support-
ed on the one side by Truth and the other
by Justice. The Orchetre in the mean
time played Jefferson's march, *nd the
whole house expressed their approbation in
the loudest plaudits.
Mrs. Mills now appeared, dressed as a
female volunteer, and sung the annexed
sing witten by Mr. Mills, and set to music
by Mr. Meinecky, called
The Host that jlght for Liberty.
" A, m arm ye brave ' ami Kubty Join,
The sons of freedom's valiant line
Columbia's lieroes now entwine,
To guard the shores ofliberty ;
No slavery jruides our warlike band,
But brei, lii-is stuk', a roihei 's hand
And Sires link, and wide expand,
The host that fight lor li erty.
The fair your martial spirits trace,
And prou.liv view ytmr warlike grace,
And rosy wreaths shall twine to place,
On those that guard our liberty ;
Ye heroes then who bravely fight,
For country and extended right,
On you the blessing ever light,
Of-freedom, love and. libertv
The entertainment concluded with acha-
racterestic country dance, in which, each
person holding a transparent letter in their
hands, the words " Baltimore /Volunteers"
were formed—at the same moment a person
entered bearing a fUe on whico wa? written
" three cheers, huzza !" and the house mi
mediately resounded with three loud cheers.
I have rarely witnessed an entertainment
which was better received; and the mana-
gers certainly de erve much credit for their
exertions in getting it up—their expenees
in so doin^ must have amount! d to a large
sum of money, but I hope the y were, or
will be remunerated by tho e they so zea-
lously endeavoured to please:
