I enclose the record of Barron v. Baltimore from RG 267 at
the National Archives. I hope that it will be of some help to
you. I apologize for the delay. I have been on a research trip
England for two weeks. When I returned the file was waiting on
desk.
That you were able to locate the notes of arguments before
the Court of Appeals is very exciting. I would love to know more
about what you have found and what was said. I have a friend who
is interested in doing a TV series on great American and British
law cases. I met with her when I was in London and learned that
they are still looking for more American cases from which to
chose. They only want 18th and 19th century cases right now, and
because the format is to be dramatization rather than documentary
they want cases that have a record of the arguements. They are
particularly interested in cases which were the first exposition
of a legal doctrine that we now consider a foundation of our
justice system. An early attempt to extend the due process
clause of the 5th amendment to protect property rights from a
state taking might just fit the bill.
Please let me know if you would like to pursue this further.
