Mclntyre and others were plaintiffs,' and Eleanor E. Monday, October 25th, 1920. At the hour of 12 o'clock M. All that desirable farm located on the county road leading from Monkton Station on the Northern Central Railway to Hereford on the York Turnpike Road in Baltimore County, and having a frontage of about one-half a mile on the said road. The farm contains about eighty-nine acres of land, more or less, the majority of ^which is tillable and in a fair state of cultivation. There is an orchard on the property of various- kinds of fruit in full bearing, and there is running water through the property. The object of this suit is to procure a decree for the sale of certain real estate located in the Second Election District of Baltimore County, near Al-berton, which is owned by Barbara E. Mitchell, deceased, at the time of her death, which occured on February 16th, 1918.
(1) The Bill states that Barbara E. Mitchell purchased said property on March 11th, 1908, and it is now rented and occupied by Miss Susie Waters.
(2) That Barbara E. Mitchell departed this life on February 16th, 1918, a resident of Howard County, and that she was never married and died intestate.
(3) That letters of administration had been duly granted on her estate to Josteph L. Donovan.
(4) That the said Barbara E. Mitchell left no unknown living heirs, so far as can be earned, and that under the laws of the State of Maryland, the Board of School Commissioners of Howard County would be entitled to said property.
The Bill therefore prays for a Writ of Subpoena and an order or publication, and asks that sale be had of s«.id real estate and the proceeds paid over to the heirs of the said Barbara E. Mitchell, if any should appear, and on the failure of any heirs said proceeds
