Second Parcel—Beginning for the second thereof at the end of ninety-seven perches on the second line of about one hundred and forty-sieven acres of land conveyed by I. Solon S. Linthicum to James I. No. 24, folio 31, etc., and running thence south eighty degrees west, sixty-three and one-half perches to intersect the given line of six acres of land conveyed or intended to be conveyed to said Linthicum; then binding on that line reversely, north seven degrees west thirty-eight and six-tenths perches to the beginning of said line, and the end of the north sixteen degrees and thirty minutes east three perches line of said six acres of land, and then along the centre of a road twenty feet wide and bounding on the land sold to Linthicum by T. A. Linthicum, trustee, in the case of Linthicum vs. I. I. Forbes atid E. C. Forbes, in 1866, north twenty degrees west twelve and seven-tenths perches; then north eighty degrees east sixty-three and one-half perches to the outlines of the whole of Forbes' land; then bounding on said outlines south ten degrees east fifty and eight-tenth perches to the place of beginning. Containing Twenty Acres of Land, more or less. The second parcel above described being subject to a right of way for the lots lying in the rear of this lot, along the western side thereof, one perch and three and one-half feet wide. WILSON, vs. ANNA WILSON. IN THE CIRCUIT COURT FOR BAL TIMORE COUNTY, IN EQUITY. The object of this suit is to procure a divorce a Vinculo Matrimonii by the Plaintiff, James H. Wilson, from the Defendant, Anna Wilson. The bill states that the parties were married at Elkton, Maryland, on or about the 2nd day of December, 1922; that no children have been born to the parties as a result of said marriage; that the said Defendant on or about the 30th day of January, 1923; without any just cause or reason abandoned and deserted the said Plaintiff; and declared her intention to live with him no longer; that the said abandonment was her final and deliberate act and has continued uninterruptedly unto the present time, and that the separation of the parties is now beyond any reasonable hope or expectation of a reconciliation; that ever since the marriage aforesaid the Plaintiff has always behaved as a kind, faithful and affectionate husband; that since the marriage aforesaid the said Defendant has committed the crime of adultery with divers men whose names are to said Plaintiff unknown; that the said Plaintiff has not lived with nor cohabited with the said Defendant since learning of the said adulterous acts nor has he forgiven or condoned her offence; that the said Plaintiff is now and has been for more than two years prior hereto a resident of Baltimore County, State of Maryland, while the said Defendant is a non-resident of the State of Maryland and resided when last heard from in the City of Philadelphia, State of Pennsylvania. Benjamin Weinstein, a son, who has intermarried with Rose Weinstein, both of whom now reside at 5401 York Road, Govans, Baltimore, Maryland. e—Louis Weinstein, a son, who is unmarried and now lives with his mother, Hannah Weinstein, near Wood-lawn, Baltimore County, Maryland. f—Manuel Weinstein, a son, who has intermarried with Minnie Weinstein, both of whom now reside at 1620 Jefferson St., Philadelphia, Pa. g—Rebecca Schuman, a daughter, who has intermarried with Joseph Schuman, both of whom now reside in the City of Washington, District of Columbia. h—The following children of David Weinstein, a son, who departed this life intestate prior to the death of his father: 1—Katie Kominetzky, a daughter, who has intermarried with Jac/ob Kominetzky, both of whom now reside in the City of Washington, District of Columbia. 2—Sadie Weinstein, an infant daughter under the age of 21 years, who now resides in Baltimore Citt/, State of Maryland. 3—Morris Weinstein, an infant son under the age of 21 years, who now resides in Baltimore City, State of Maryland. 4—Julius Weinstein, an infant son under the age of 21 years, who now resides in Baltimore City, State of Maryland. 5—Louis Weinstein, an infant son under the age of 21 years, who now resides in Baltimore City, State of Maryland. The Bill further alleges that the said Jacob Goldman and Solomon Weinstein were neighbors and close personal friends for a number of years, and that on or about the 7th day of August, 1917, the said Weinstein requested the said Goldman to purchase for him certain real estate upon which he was then living, it being understood and agreed that the said Goldan would put up the necessary purchase money and take title thereto in his name, the said "Weinstein to have the right to remain on said property so long as he wished to do so upon payment to .the said Goldman of interest on the purchase money, taxes and insurance; and it was further understood and agreed that the said Weinstein, at any time before his death, would be entitled to the conveyance of said property from the said Goldman and wife upon payment of the aforesaid purchase money, interest, taxes and other expenses, but the said Weinstein failed to redeem said property before his death. That in pursuance of the aforegoing understanding and agreement with the said Weinstein, the said Goldman did purchase four certain lots of ground and the improvements thereon situate near Wood-lawn in the First Election District of Baltimore County, the title to which was conveyed to the said Jacob Goldman and wife by deed from Hyman Subkov and wife dated August 7, 1917, and recorded among the Land Records of Baltiore County in Liber W. P. C. No. 485, folio 215, etc., the original of said deed being filed with the Bill! marked Complainaant's Exhibit No. 1. i The Bill further alleges that the! said Goldman and wife laid out the principal sum of $2,752.30 toward the] purchase of said property at the request of the said Weinstein, and that SALES AND LEGAL NOTICES. the total amount of money advanced, with interest, to August 8, 1924, is $3,008.26, as shown by an itemized account filed with the bill marked Complainants' Exhibit No. 4. The Bill further alleges that there has been no administration upon the personal estate of the said Solomon Weinstein and that the Plaintiffs are advised and therefore aver that he left no personalty. The Bill further alleges that the Plaintiffs have on a number of occasions since the death of the said Solomon Weinstein offered to convey the aforesaid property to his heirs at law, upon payment to them of the indebtedness set forth in Exhibit No. 4, but said heirs have failed to avail themselves of said offers. The Plaintiffs are now desirous of getting their money out of said property and, in order to give the heirs of the said Weinstein the benefit of any equity that may remain therein, th'ey ~ask the court to intervene and grant the following relief: 1—To decree that the deeds to said property now held by the Plaintiff are in effect, mortgages to secure the payment of the indebtedness set forth in Exhibit No. 4. 2—That the Defendants be decreed to pay to the Plaintiffs the amount of their claim as aforesaid, together with the costs of this suit, by a short day to be appointed for that purpose; or in default of such payment— 3—That the aforesaid property may be decreed to be sold and that a trustee or trustees be appointed to make such sale and to bring the proceeds thereof into court for distribution under the court's direction and control to those entitled . Carlton Hueter, her husband, all of full age, residing in Baltimore City, Maryland, and William Justus Martell and Emma Martell, his wife, who reside in Allentown, Pennsylvania, all of which parties have been made proper defendants, and also all other unknown heirs of Justus Martell, deceased, if any there may be; that the said property is not susceptible of partition in kind without loss and injury to the parties interested.
