| THE JEFFERSONIAN, TOWSON, MARYLAND Saturday, February 23, 1924—Page 5 general sys/tem, use and operate said completed /or partially completed system or W'ate rmain, sewer or drain; and mas' use, operate or acquire the same bv? gift, purchase, condemnation, lease 'f>v .otherwise, and require all piopei/ties within reasonable distance there/from to be connected therewith, and /said properties shall thereupon be lia>/le for the payment of such cnarges _ the Commissioners may think right }*6id proper, and all of said properties connected with or to be connected with the said completed or partially completed water supply, sewerage or drainage system, shall be subject to all of the provisions of this Act, and . be under the control of said Commis- ** sioners just as though they were connected with the system to- be constructed by the Commissioners hereunder, and this Act and all parts thereof shall in like manner and extent apply to and affect the same or the Commissioners may require such system or partial system, or water main, sewer or drain, to be connected with their general system of water supply, sew-1 erage or drainage, and shall prescribe | the annual charge to be paid by the owner for such connection; or the Commissioners, if they find that such j existing water mains, sewers or drains i are in any way unsuitable, in the -judgment of the State Board of Health of Maryland, for incorporation with the system under their control, shall ! disregard the existence of such water j mains, sewers or drains and construct ' their own water mains, sewers or drains in the territory served by said ! existing water mains, sewers or drains, : and shall require all properties within such territory to be connected with j the system built by the Commissioners, in the same manner as provided under Sections 5 and 8. Before any existing water supply, sewerage or drainage system, water main, sewer or drain or appurtenance thereof or connection therewith, is connected with the system controlled by the Commissioners, the owner of said existing water supply, sewerage or drainage system, water main, sewer or drain, or appurtenance thereof or connection therewith, shall make such change in or repairs to it as the Commissioners may deem necessary to put it in proper shape for connection with the Metropolitan System, unless such I system, main, sewer or drain shall I have been acquired by the Commis- j sioners. The provisions of this Section shall not apply to the properties, ' plants, franchises or rights of the j Mayor and City Council of Baltimore, i or to any properties, plants, franchises ¦ or rights hereafter acquired by the | Mayor and City Council of Baltimore for the protection or enlargement of j its water supply, sewerage, storm- | water drainage or refuse disposal sys- I terns of any other of its utility prop- | erties, except with the consent of the; Mayor and City Council of Baltimore, j Section 14. AND BE IT FURTHER1 ENACTED, That all individuals, firms; and corporations lawfully having build- j ings, structures, works, conduits, I mains, pipes or other physical ob- j structions in, over or under the public j lanes, avenues, streets, alleys or high- : ways of the Metropolitan District, j which shall block or impede the pro- ; gress of the Commissioners' water: mains, sewers or drains, when in pro- ' cess of construction, and establishment shall, upon reasonable notice from said Commissioners, promptly so shift, adjust, accommodate or remove the same, as to fully meet the exigencies occasioning such notice; and should the exigencies of 3ald work in any case' involve a taking, in the constitutional sense, of the franchise or right in the exercise of which such obstruction had its origin, or of the property subject ithereto, the Commissioners shall be empowered to secure the condemnation of such franchise or right and of the property subject thereto. No water supply, sewerage or drainage system which may have been laid out, constructed or operated, before the passage of this Act, under the rules and regulations and authority of the State Board of Health and the Baltimore County Commissioners, shall be disturbed except by consent of (fee owner thereof or by condemnation proceed-4fr ings as herein provided. The provisions of this Section shall not apply to any property owned by the Anne Arundel County Sanitary Commission, or its successors, into which the water supply, sewerage or drainage systems established by the Commissioners shall extend. The provisions of this Section shall not apply to the properties plants, franchises or rights of the Mayor and City Council of Baltimore or to any properties, plants, franchises and rights that may be hereafter acquired by the Mayor and City Council of Baltimore for the protection or enlargement of its water supply, sewerage, storm-water drainage or refuse disposal systems or any other of its utility properties. Section 15. AND BE IT FURTHER, ENACTED, That whenever three-fifths of the registered voters now residing in any locality in Baltimore County adjoining the Baltimore County Metropolitan District, but outside the boundaries thereof, as constituted by Section 1 of'this Act, shall, in writing, petition the Commissioners to have the locality (the boundaries whereof shall be definitely stated in such petition) included within the Metropolitan District, the Commissioner "iai' in their dis-stion, by and with the consent and approval of the Mayor and City Council of Baltimore, extend said District to include said locality, which locality shall become a part of said District and subject to all the provisions of this Act, upon the recording of such petition, together with the written approval of the Commissioners, and the Mayor and City Council of Baltimore, in a book to be kept by the Commissioners for that purpose, and upon such publication as the Commissioners shall deem proper. Section 16. AND BE IT FURTHER ENACTED, That the Commissioners may enter upon any State or County street, road or alley, or any public highway, for the purpose of installing, maintaining and operating the water supply, sewerage and drainage systems provided for under this Act, and it may construct in any such street, road or alley or public highway, a water main, sewer or drain, or any appurtenance thereof, without the receipt of a permit or the payment of a charge; provided that, wnenever any State, County or municipal highway is to be disturbed the public authority having control thereof shall be duly notified, and provided further that said highway shall be repaired and left by the Commissioners in the same, or a not inferior, condition to that existing before being torn up, and that all costs incident thereto shall be borne by the Commissioners. The provisions of this Section shall not apply to the properties, plants, franchises or rights of the Mayor and City Council of Baltimore or to any properties, plants, franchises and rights that may be hereafter acquired by the Mayor and City Council of Baltimore for the protection or enlargement of its water supply, sewerage, storm-water drainage or refuse disposal systems or any other of its utility properties. Section 17. AND BE IT FURTHER ENACTED, That any employee or agent Of the Commissioners shall have the right of entry, at all reasonable hours, upon any private premises and into any building within or outside of the Metropolitan District, while in the pursuit of his official duties, but in the event that any property owner or tenant objects to such entry, than the chief sanitary engineer or one of his assistant engineers only shall have the right of entry, and any restraint or hindrance offered to such entry of the chief sanitary engineer or one of his assistant engineers by any owner or tenant, or agent of said owner or tenant, shall be a misdemeanor, pun-isnaole under Section 19 of this Act. Section 18. AND BE IT FURTHER ENACTED, That every public service corporation, company or individual before it or they shall begin any construction in any street, road, alley or public highway within the Metropolitan District, shall file with the Commissioners a plan of such construction showing the location and deptii, in such street, road, alley or public highway, of the proposed main, conduit, pipe, or other structure; which plans must be approved by the Commissioner other structure, as shown upon the and wnen approved no change shall be made in the physical location of anything shown upon said plan except upon the approval of tne Commissioners. Whenever any public service corporation, company, or individual shall begin to put any such main, conduit, pipe, or other structure in any such street, road, alley or public highway without first filing plans with the Commissioners and obtaining the approval thereof, as above provided, or shall without the approval of the Commissioners, make any change in the location of such mains, conduit, pipe or othe rstructure, as shown upon the plans approved by the Commissioners, or any approved change therein, such action shall constitute a misdemeanor punishable as described in Section 19 Of this Apt, and the Commissioners may, wfcafi any such main, conduit, pipe or other struct'tfr* interferes with the construction or operation of theii* water or sewer systems or ' any of them, remove the same or change the location thereof. The provisions of this Section shall not apply to the properties, plants, franchises or rights of the Mayor and City Council of Baltimore or to any properties, plants, franchises and rights that may oe hereafter acquired by the Mayor and City Council of Baltimore for the protection or enlargement of its water supply, sewerage, storm-water drainage or refuse disposal systems or any other of its utility properties. Section 19. AND BE IT FURTHER ENACTED, That very act designated as a misdemeanor in this Act, unless otherwise provided, shall be punishable upon conviction before any Justice of the Peace or in the Circuit Court of the County within which such offense is committed, by a fine not exceeding $100 or imprisonment for thirty days in the County Jail, or both, in the discretion of the Court or Justice. Where such act or omission is of a continuing nature and is persisted in, I in violation of the provisionss of this j Act, or of any ruie or regulation for-I mulated thereunder, a conviction for I one offense shall not be a bar to a, conviction for a continuation of such offense subsequent to the first or any succeeding conviction. Section 20. AND BE IT FURTHER ENACTED, That nothing in this Act shall be taken or construed to abate, terminate or in any other manner affect any proceedings which have been conducted and carried on under the provisions of Chapter 187 of the Acts of 1916, as amended by Chapter 35 of the Acts of 1922, or any certificates of indebtedness issued or to be issued thereunder, or under any other existing law at the passages of this Act, but such proceedings begun thereunder and which are pending at the passage of this Act shall be prosecuted and concluded in the same manner as if this Act has not been passed. Sectio n21. AND BE IT FURTHER ENACTED, That all Acts or parts of Acts, general or local, inconsistent with the provisions of this Act, be and the same are hereby repealed to the extent of such inconsistency, provided that nothing contained in this Act shall effect or restrict anv control which the State Board of Health of Maryland is empowered by law to exercise in any part of this State. And provided that nothing in this Act shall be construed to repeal or in any other manner affect the authority, rights, privileges and powers granted to the City of Baltimore under the provisions of Chapter 349 of the Acts of the General Assembly of 1904 and Chapter 214 of the Acts of the General Assembly of 1908, and any amendments thereto, which said authority, rights, privileges and powers are hereby ratified and confirmed. Section 22. AND BE IT FURTHER ENACTED, That this Act is hereby declared to be an emergency law and necessary for the immediate preservation of the public health and safety, and being passed upon by a yea and nay vote supported by three-fifths of all the members elected to eavh of the two Houses of the General Assembly, the same shall take effect from the date of its passage. That there are no children as a result of said marriage. That although the conduct of the Plaintiff towards his wife, the said i-lazel Baker Buck, has always been kind, affectionate, chaste and above eproach, she, the said Hazel Baker Buck, has, without any just cause or reason abandoned and deserted :hinr and has declared her intentions to live with him no longer, that said abandonment has continued uninterruptedly for at least three years, is deliberate and final, and the separation of the parties is beyond any reasonable hope of reconciliation. That since the abandonment aforesaid the said Hazel Baker Buck has committed the act of adultery with various men whose names are unknown to the Plaintiff, and that about three years subsequent to the abandonment aforesaid the said Hazel Baker Buck bore a child, the father of which child is some other than the Plaintiff.
