It is said that the house of delegates of this state have passed the school bill, 49 •¦ I to 17-—haw voted an appropriation of tvt thousand dollars for the erection of a penitentiary, 31 to 29—that the journil of accounts was ordered to be closed, and thbt tlie legislature were to have adjourned on Friday or Saturday last. from the Secretary of the treasury, respect- ing public lands, widen, was referred to the committee 0:1 public lands, A memorial was presented from David Gelston, collector of the port of New-York, stating that owing to the frauds of persons holding American registers, in covering fo- reign vessels, he had been induced, by the advice of the United States' attorney, to seize some vessels, on suspicion of their be- ing foreign property ; but that not being able to produce sufficient proof, suits had heen commenced, and damages awarded against him, to the amount of 9974 dollars, and praying congress to grant him indemni- fe-.ition. Referred to the committee of ways and means. Mr. Dawson, from the committee to whon ¦was recommitted the " 15ill to provide for the punishment of certain crimes against the United States," made a report, to strike out. the 3d section of the bill. Referred to a committee of the whole house on Monday. Mr". Dana rose and observed, that four suits were pending against persons, in cases not provided for by the coustitutisu or laws of the United States, but were carried on under the common '<;w of England : two of these suits were against printers, for pub- lications in their p.ipers ; and two were against clerical characters, for words which they had uttered. He wished to know, whether persons accused should not be al- lowed to give the truth in support of their charges. Under the common law, nothing further was necessary to be done, than that the publication or assertion should be proved to have been made : the truth c.f them was not allowed to be given in evidence. He then submitted the following resolution : Resolved, That a committee be appointed to enquire whether prosecutions under the common law should be sustained in the courts of the United States, for libellous publications or defamatory words touching persons holding offices or places of trust under the United States, and whether it would not br- proper, if the same should be sustained,' to. allow the party prosecuted the liberty of giving the truth in evidence ; and that the committee have leave to report by bill or otherwise. Mr.lV.na moved that the resolution be re- .0 a committee of the whole house. This motion was opposed by Mr. Bidwell, Mr. Campbell, and Mr. Smilie, on the ground that it would bo improper to refer it to a ce-uiittee of the. wdiole before it was re- ferred to a select committee. It was sup- ported by Mr. J. Clay, who 3aid that by the seMkm. law a man was allowed to give tfie truth in evidence, which was not the case under the common law, as it had been acted upon in a certain district of the union : under the latter, therefore, a man was in a worse situation than he would have been under the farmer, The question was then taken on referring the resolution to a committee of the whole house, and it was carried in the affirmative, and made the order of trie day for Thursday. Mr. J. .Clay, from the committee to whom was referred the petition of sundry paten- tees, reported " a bill for the encouragement of learning and the promotion of the-usefuj arts," which was read twice, and referred to a committee of the whole house on Tues- day next. On motion, resolved, That a committee [of-seven members] be oppointed to enquire whether any, and if any, what further pro- vision ought to be made bylaw for prescrib- ing the manner in which the public acts( records and judicial proceedings of one state shall be taken in other states, and the effect thereof; and that they have leave to report by bill or otherwise.
