AN ORDINANCE
To appoint city commissioners, and pre-
scribing their duties.
T. Be it enacted and ordained by the may-
or and city ccuncil of Balt'mare, That three
persons, one of whom shall reside on the
east side of Jones' falls, and two on jlhe
west side thereof, shall be appointed city
commissioners, and they, or a majority of
them, shall do and perforin all the duties
prescribed and required to be done and per-
formed by city commissiones, by any of the
ordinances of this corporation : and shall
appoint a clerk, and said commissioners and
clerk shall receive such compensation, as
shall he annually appropiiated for their ser-
vices ; and the said commisior.ers, or a ma-
jority of them, on the first and third Mon-
days in every month, at such place and
time as they may appoint, shall meet and
consult together, (of the place, day and
hour, of which meetings, public notice
shall be given) respecting the levelling,
pitching, paving, or repairing the streets,
lanes and alleys, or bridges-within the city,
or for mending, making, or repairing of
sewers, within the said city or precincts ;
and to contract with any person for mate-
rials, for the purposes aforesaid, and with
as many workmen as they may judge neces-
sary to be employed from time to time, in
and about the same. And the said com-
missioners may, with the approbation of
the mayor, from time to time, proceed to
the paving of such streets, lanes and alleys
only, as a majority of the proprietors and
tenants inhabiting .thereon shall require ;
and the outer edge of the footway thereof
shall be secured by good and sufficient kerb-
stones, and the footway on each side shall
be one-fifth of -the width of such street, iane
or alley.
II. And be it enacted and ordained, That
the clerk of-the city commissioner:, -diall
keep a fair journal of all their procftedir.gs,
and as far as they may relate to the con-
demnation of streets, the leveling of the
streets, lanes and alleys, and the establish-
ment of boundaries, or the making of
sewers, he shall return under the hands
and seals of the said commissioners, at
at least once in every three months, to
the register of the city to be by him record-
ed and filed in his office. >
III. And be it enacted and ordained, That
the said, city commissioners shall have full
power and authority, and they are hereby
authorised and required, when applied to by
any person requiring the same, to ascertain
and fix the lines of any of the streets, lanes
and alleys, or any boundary of any of the
lots within said city, and having so fixed
and established the same, to.put up stones
or land marks to be provided for that pur-
pose by the .person or persons requiring the
same to be done, at such place or spots so
established by them, and to make return
thereof, in writing of such establishment,
with the proper description thereof, under
titer hands and seals to the register, who
shall immediately record the same, in a
book to be provided for that purpose ; and
shall file, aad keep the original record or.pa-
per so returned as aforesaid in his office.
IV. And be it enacted and ordained, That
no owner or owners of any lot in the city
shall dig or lay the foundation of any hou-:e
in front of any street, lane or alley, or erect
any wall or fence fronting thereon, before
he, she or they shall have applied to the
city commissioners, to mark out the true
line of such street, lane, or alley ; (unless
thecornersof the square-on which such im-
provements arc to be made have been duly
established,) and every commissioner so ap-
plied to, is hereby authorised and required,
to see that such foundation, building, house,
or wall, do and shall not encroach upon the
same ; and said commissioners shall have
a right to empl y, if they deem it necessa-
ry, on every such occasion, a surveyor, at
the cost of such owner, or owners, and e-
vcry person or persons neglecting to apply
as aforesaid, shall forfeit and pay five dol-
lars for each and every offence, and live dol-
lars for each and every day while such di-
rections aforesaid are not complied with, in
case such wall, house, or building, shall
encroach upon the street.
V. And beit enacled and ordained, That
the city commissioners shall have full pow-
er and authority, and they are hereby au-
thorised and directed when called on by a-
ny person requiring their attendance, to re-
gulate all party walls and partition fences
within the city, in such manner as may in
their judgment be most likely to promote e-
qual justice between the parties concerned,
and shall immediately thereafter make return
of every such proceeding under their hands
and seals to the register, to berecorded and kept
with every paper and voucher relative there-
to, in such manner as before directed ; and
when, and as often as the said city commis-
sioners shall meet, to fix and establish any
street, lane, or alley, or to fix and estab-
lish any boundary of any lot within the said
city, or to regulate any party wall or parti-
tion fence within the same, they shall, and
they are hereby required to give at least four
days notice, in at least two of the newspa-
pers of the said city, of such intention,
specifying the time when and place where
they are to-meet together, with the intenti-
on of such meeting, and shall, before they
fix and establish any such streets, lanes, or
alleys, or any boundary of any of the lots
within the city, or regulate any party wall
or partition fence as, aforesaid, obtain the
best information on oath or affirmation, the
case will admit of ; which evidence, with
every voucher and paper relating thereto,
shall be returned with their certificate afore-
said, to be recorded as aforesaid. And all
the power over the said streets, lanes, and
the said city, heretofore granted to the com-
missioners of Baltimore town, and special
commissioners shall be, and is hereby trans-
ferred to and vested in the said city commis-
sioners ; and each of the said commission-
ers shall receive for the use of the city from
the person or persons requiring their servi-
ces, the sum of one dollar for each and e-
very day they shall attend in virtue of this
ordinance. ,
VI. And be it enacted and ordained, That
if any person or persons, shall think him,
her, or themselves aggrieved by the deter-
mination of the said commissioners, in the
fixing the lines of any street, lane or alley,
or the boundary of any lot, or in fixing the
grade of streets, lanes and alleys, if the
proprietors of tire greater portion of ground
fronting thereon shall think themselves ag-
grieved ; in such case, every such person or
persons, or such proprietors, as the case
may be, may within five days next after
such determination, appeal from the same
to the mayor, who shall have full power
and authority to issue a warrant summoning
five disinterested persons of known ability
and discretion, (the determination of whom,
or a majority of them shall be final) to settle
all matters in dispute within ten days there-
after ; and return their award in writing to
the register, to be by him recorded. And
before the persons appointed under said war-
rant shall proceed to the execution of their
duties, they shall make oath or .affirmation,
that they will impartially examine the pro-
ceedings of said commissioners, from which
an appeal is prayed, and confirm or alter
the same, as in their opinion is just, with-
out favor or partiality ; and the said persons
shall receive from the city commissioners,
all documents and information which influ-
enced and directed them in said determina-
tion liom which the appeal is made.
Vfl. And be, it enacted and ordained,
Thai the said commissioners shall have full
power and authority to enter upon the lots,
grounds, or possessions of any person or
persons, bodies corporate and politic, thro'
which the common sewers now or may
hereafter run, or ought to run, to regulate,
make or repair the same, Provided tikt no
common sewer, or water course here-
after to be made and laid out, shall be re-
gulated so as to run through any lot of
ground belonging to any private person or
persons, body politic or corporate, unless
the same shall be agreed to and approved of
by a majority of the said city commissioners,
and in every such case the* damages sustain-
ed by reason thereof, by such owner or
owners, body politic or corporate, shall be
valued and ascertained by two persons, in-
differently chosen, one by the said city
commissioners, and the other by the owner
or owners thereof, with a p-jwer in the said
arbitrators to call in an umpire, and the
award of said arbitrators, or a .majority of
them, shail be final : and the clamages so
assessed a?nd ascertained, shall be paid to
the owner or owners, so aggrieved, »cmt of
any unappropriated money in the treasury.
VIII. And be it enacted tand ord.
That the city compissioners be and they
arahereby directed, vThen -.nyofthe bridges
within the city stand -in need of repairs,
to amend and rep;.'r the seme in, such man-
ner as they,- with the approbation of the
mayor, may think fit,,and draw upon the
register for the amount thereof.'
IX. And be it enacted and ordained, That
whenever it shall be decided upon to pave
any street, lane or alley, in the said city,
the commissioners shall make or cause to be
marie, a correct list of the names of the
sc s who are liable to pay the paving
sd the amount to be paid by each
person, and shall assess and levy the same
at the rate of nine cents on each square
foot, except the part allotted by ordinance
for footways ; and .;they are hereby directed
to deliver to the city collector, a duplicate
of such amount, under their hands and seals,
with directions for collecting the said tax ;
nevertheless correcting any mistake in the
said list, as often as they may be satisfied
of the same. And the said collector shall
collect the same by distress or otherwise,
giving thirty days notice agreeably to law,
previous to such distress, and pay over the
amount to the register. And the city com-
missioners are hereby authorised and direct-
ed, to draw on the register for such amount
of the tax, and to apply the same to the
paving of the street, lane or alley, where
the tax may be collected ; and should said
tax raise more money than would be suffici
ent to pave the same, that the overplus shall
remain in the treasury, for the use of the
city; but should the said tax not be suffici-
ent to pave the same, that then, the defici-
ency shall be made up out of the money
appropriated to the city commissioners for
that purpose.
X. And be it enacted and ordained, That
the city commissioners be, and they are
authorised and impowered to erect, set up,
or place a rope, chain or bar, in or across
any of the streets, lanes or alleys of the
city, which they may be about to pave,
amend or repair, for such time as they may
think necessary ; and that if any person or
persons shall throw down, remove, or ob-
struct such rope, chain or bar, every such
person shall fprfeit and pay tor every such
offence the sum of ten dollars.
.XI. And be it enacted and ordained, That
the owners or possessors of any house or lot,
in front of which the street, lane or alley,
has heretofore been paved, or hereafter
may be directed to be paved, are required
to pave, amend or repair the footway in
such manner and in such time, as shall be
directed by the city commissioners, provid-
ed ten days notice be given by the said com-
missioners in some newspaper of the city of
Baltimore, to said owners or possessors,
residing without said city, or the precincts
thereof, and the like notice in writing to
such owners or possessors residing with-
in said city or precincts, and in case
such owners or possessors of such house
or lot, doth not pave, amend or re-
pair.the footway aforesaid, agreeably, to the
directions aforesaid, that then the city com-
missioners are hereby authorised and direct-
ed te contract with any person or persons
for such sum oi shall be
sufficient to pave, amend and repair the
same ; and to charge the same to such own-
er or possessor, v\ ho shall forfeit the said
sum together with the one-eighth of a dollar
per foot in length as a fine fors'.ieb negteet
or refusal, Provided always that the posses-
sor of such house or lot shall, in the first
instance be obliged to pay such sum or sums
of money, directed as aforesaid ; and the
city commissioners are hereby directed to
pave, amend and repair such footway, and
j the fine arising to pay .to the register of the
city, and in case the paving, amending and
repairing is done by the commissioners,' un-
der the authority and direction aforesaid, the
said commissioners are hereby further au-
thorised to draw on the register of the city,
for any unappropriated money in his hands,
to defray the expences thereof, in anticipati-
on of the sum or sums that are to be col-
lected, from the owner or owners, in pur-
suance of the direction aforesaid.
XII. And be it enacted and ordained,
That the city commissioners be, and they
are hereby direct' d, when they contract
for the paving of any street, lane or alley,
that requires to be filled up, to give five days
notice in writing, to the owners or posses-
sors of the lots on such street, lane or alley,
if in the city, or if not in the city, to pub-
lish the same in some one of the newspapers
thereof, to make their election or choice
of filling up their footways, at the same
time that such street, lane or alley is filling
up, and in case the owners or possessors
aforesaid, Shall neglect to ..II up said foot-
ways at the time aforesaid, that then the
said commissioners shall, and they ate here-
by directed to have the same filled up to
such extent, and in *.ch manner as they
may tbHik lit, at the proper cost and charge
of such owner or possessor so neglecting^
to be recovered in the same manner as fines
and expences for neglecting to pave, amend
and j epair footways, are re. verable ; and if
it be rburd necessary, the city commission-
ers may draw on the register for the pay-
ment of any expences incurred in anticipa-
tion of the recovery aforesaid.
XIII. And be it enacted and ordained,
That if the commissioners of,health shall
at any time report in Writing to the city
commissioners, that a nuisance exists in any
street, lane or alley in the city of Haltimore,
which will endanger the health thereefj and
the «ty commissioners upon a full examina-
tion thereof, should be of the same opinion,
and that the same cannot be effectually re-
moved without paving such street, lane, or
alley, they are hereby authorised and re- .
quired, to proceed to the paving of such
street, lane or alley, and to issue their war-
rant under their hands to the city collector,
directing K llect the tax which may
be imposed for the pa dng of the same, and
when collected and received, to pay the same
over in the eame manner as he is herein be-
fore directed. Provided nevertheless, that
before the said warrant shall issue, it shall
be approved of by the mayor, and the tax to
be imposed in virtue of thisordinance, shall,
be the same a* herein before is established
and that the city, commissioners shall have
full power to pave the same by contract or
otherwise.
XIV. And be it enacted and ordained,
That whenever :the owners of houses, or
lots, fronting on any paved street, or part
of a street, whereof the footway is now
guarded by posts, shall make application in.
writing to the city commissioners, to have
the footway in front of such street, or part
of a street, widened and extended to the
width now limited by this ordinance, the
sdd commissioners be. and they are hereby
authorised and directed, to proceed to the
making of such alteration, and the owner
of" any house or lot, fronting on any street,
or part of a street, whereof the footway is
intended to be widened, is required and di-
rected to pave, amend or repair the footway
in front f his house or lot, aftsr the kerb-
stone is set in such manner and in such time,
as shall be directed by the said commission-
ers, who shall give ten days notice in same
news-paper of the city of Baltimore, direct-
ing the paving, amending or repairing such,
footway ; and in case the owner of any such
house or lot, doth net pave, amend or repair
the footway aforesaid, agreeably to the di-
rection aforesaid, then and in that case the
city commissioners are hereby authorised
and directed to contract with any person or
persons for the paving, amending or repair-
ing the same, for such sum or sums of mo-
ney, as shall be sufficient to pave, amend or
repair the same, and to charge the same to
such owner, who shall forfeit the same sum,
to be recovered with costs, and the collec-
tor's commission, in the same manner as
taxes are directed to be recovered.
XV. And be it enacted and ordained, That
the said cily commissioners be, and they are
hereby authorised and directed to regulate
the pitch and take up, lower and repave
such part of the street pavement, as they in
their judgment may find necessary, to lay the
gutters, and to carry off the water from the
footway, one-half part of the expence of do-
ing the same shall be apportioned among,
and be paid for by the owners of the houses
or lots fronting on the street or part of a
street where snch pavements shall be so re-
gulated and lowered, and the said one-half of
the expence when ascertained by the saicl
city commissioners, shail be collected frorr^
the owners of houses or lots aforesaid,- in the
same manner as the tax for paying, amend-
ing or repairing the footway is by this or-
dinance directed to be collected, and subject
to the same commission for the collecting
thereof.
XVI. And be it enacted and ordained Th;>$
the said city commissioners are heieby au-
thorized and directed, to procure kerb-stones
for the purposes aforesaid, and for all foot-*
ways that shall be made hereafter, which
shall net be less than four inches in thick-
ness, and not less than sixteen inches in
breadth or depth, and that the one t
thereof, which is to be fitted to the foot
