The Funeral Sermon of the late Mr. Thomas 'Sutton, will be preached to-mor- row, the third inst. at 3 o'clock in the af- ternoon, -at the Methodist Meeting-House, Fell's-Foint. The Three Friends, from Baltimore, has arrivfcd at Boston. The result of the'election in Connecti- cut is, that governor Trumbull, lieutenant- air Troad.vell, and the present se-- cretary and treasurer are re-elected by very large majorities. In the house of re pre- ent- atives we observe that a triumphant majori- ty in favor of the steady habits of the state is again returned. The whole number of representatives is one hundred and ninety - ¦ four. Of these 62 are democratic, and .32 federalists. Remarkable Wh irlwind. On Wednesday last, about three o'clock took place the most tremendous Hurricane or Whirldwind ever experienced inthis coun- try. At the Fork Meeting-House, called the Methodist Meeting, near the dwelling of Achilla Hall, esq. were swept away seven- teen houses, and several large trees and fen- ces were swept off in. fact, not a single ves- tage left in that thriving place except the meeting-house and dwelling-house of C. («jrs, uch. The hurricane continued its oourss from thdnce northerly across the Falls of Gunpowder to Harford county ; and- lamen- table to tell ! the devastation committed in blowing 'town trees and fences, and entirely n*ed the property of David Lee, Junr. living near t'V Friends' Meeting House, in said county, &c. [American.] From a London paper. COURT OF KING'S BENCH, Feb. 2 This day being the purification of the Virgin Mary, was a di.es ncn in term, and of course the judges did not sit as usual ; but at nine o'clock this morning, lord El lenborough sat at Nisi Prim, when several causes were disposed of, among which were the following : Littltwood v. Baltic. This was an action for goods sold, and was interesting chiefly with respect to the law as to making bargains. The plaintiff sold five leads of straw to the defendant at forty shillings per k>ad, amounting to 101. Mr. Park, for the plaintiff, proved the de- livery, by the straw being brought to the defendant's premises, about two months af- ter the bargain was made ; but, to. .rebut that, Mr. Garrow, for the defendant proved, that when the straw Jwas brought hume, it turned out to be of inferior quality from that which his client had bargained for, and was refus- I to be taken in. Upon these grounds, he therefore' contended, that in of-J-iw, there was no delivery. Lord Elienborough observed, that if such :¦ bargain as this was to .bind a party, no raar.' couli safyly venture tp treat foi any commodity whatever. By the statute of frauds, where a sale has been made, amount- ing to 101. and upwards, tiiere must bs one of three things complete, in order to bind the party, a memorandum in writing, a de- livery of part of the goods sold, or earnest paid, In this case none of these appeared to have been done, and the plaintiff was accordingly nonsuited. Communication. The following anecdote of Loi?n Chief Justice Holt forms so striking a contrast with recent occurrences in the United Stales, that I have copied it for your Gazette. Had our Lord High Admiral, as he is termed by one of his " water-closet* heroes, possessed as much regard for the privileges of his fel- low-citizens as a British judge, we should not have seen such extraordinary and illegal measures taken to insure the destruction of the power of an ancient rival. HORNET. " He had a just sense, of theVxtreme dan- ger of calling in the military power, under the pretence of assisting the civil magistrate in tile execution of the laws ; and lit- would on no occasion countenance any thing of the kind. Whilst he held the office of chief justice, a riot happened in Holboru, occasion- ed by a practice, in which many persons were then engaged, of decoying young peo- ple of both sexes to the plantations. The persons decoyed were kept prisoners in a house isl that street until an opportunity oc- curred of shipping them off; which being discovered, the enraged populace were go- ing to pull down the h use. Notice of this eat to Whitehall, a party of the guards Were commanded to march to the place, but they first sent an officer to lord chief justice Holt, to acquaint him with the design, and to desire him to send some of his people to attend the soldiers, in order to give more weight to t his proceeding. The oificwr hav- ing delivered Ins message, the chief justice said to him, •' Suppose the populace should not disperse at your appearance, what are you to do then ?">" Sir," answered the of: ficer, " we have orders to lire upon them." "Have you, sir?" replied his lordship-; " then take notice of what I say : if there In' one man killed, and you are tried before me, I will take care that you, and every sol- dier of your party, shall be hanged! Sir," added he, " go back to those who sent you, and acquaint them, that no officer of mine shall attend soldiers ; and let them know at the same time, that the laws of this king- dom ARE NOT TO BE EXECUTED BY THE SWORD." ; ' long to the civil p-.icer, and you have milling to do •with them." " Upon this the lord chief justice ordered his tipstaves with a lew constables, to attend hen, and wen:, Idmselfiu person to the place where the tuhjull had arisen, expostulated with the mol 1 .md assured them that justice ; lone upon the persons who were the Object . of I hi .- i dignation : upon which they aHquiftly disiKx-'ed."
