If it was necessary for the ollicer to have a telescope, evidence must be produced that the article was properly disposed of and accounted for, before the United Slates can be chargeable. This charge is predicated on orders from the Major General to deliver arms to the 5th and 51st Maryland regiments, anil receipts for the issue of 254 stands, in April, 1813. The United States having paid the expenses of transporting 500 stand of arms from Fredcricktown, in April, 1813, incurred by the city of Baltimore, and the corporation, it appears, having received payment from the State of Maryland for 526 stand of arms, it is presumable that the above 254 stand were a pari, cilher of those received by the corporation from the arsenal at Fredcricktown, or of those for which they received payment through the Stale of Maryland. Under these circumstances, and there being no evidence of the actual purchase and cost of the article, the charge was disallowed. For his services as Secretary attending (lie Committee ol* Accounts.
