MILLING, Assignee, vs. JOHN DAKEC. IN THE CIRCUIT COURT FOR BALTIMORE COUNTY, IN EQUITY. The petition of William A. Sullivan, who sues fol- himself and all other creditors, against William H. Milling, Assignee, Joseph Jeffers, Administrator of John Dakec, deceased; Julia Dakec, mother of said John Dakec and the unknown heirs and next of kin of John Dakec. The object of said petition is to have the Court by its decree direct payment of William A. Sullivan's claim of four hundred and sixty-six dollars and thirty-five cents ($46.35) and interest and the claim of other creditors, if any there be, out of the funds now in the hands of, or to come into the hands of William H. Milling, Assignee, because of insufficiency of the personal estate of said John Dakec. The petition states that John Dakec, late of Baltimore County, died on July 16, 1922, intestate; that leters of administration were duly granted by the Orphans' Court of said County unto Joseph Jeffers; that said John Dakec did not leave personal estate sufficient to pay the debts and costs of administration of his estate; that said John Dakec died seized in fee simple of the property described in a deed dated April 26, 1921, recorded among the Land Records of said County in Liber W. P. C. No. 538, folio 507 from Tekla Milosh; that said John Dakec by mortgage dated April 26, 1921, recorded among the Mortgage Records of said County in Liber W. P. C. No. 599, folio 39, mortgaged said property to Joseph Jeffers and Annie C. Jeffers, his wife, to secure an indebtedness of $2,000.00 and interest; that said mortgage being in default said Mortgagees assigned the same for the purpose of foreclosure to said William H. Milling, by assignment dated October 24, 1923, recorded among said Mortgage Records in Liber W. P. C. No. 599, folio 43, that said William H. Milling, Assignee, foreclosed said mortgage and sold said property for $4800.00; that said sale was duly reported to and finally ratified by this Honorable Court and the Auditor's account has been duly filed and ratified by this Honorable Court; that said Assignee has now on hand the sum of $632.64, as will appear by said Auditor's account and that there will be payable to said Assignee twelve months from November 26th, 1923, the further sum of $1600.00 and interest, making in all the sum of $2232.64, with interest on $1600.00; that said petitioner is a creditor of said John Dakec in the sum of $466.35 evidenced by three judgments all dated July 28th, 1924, duly entered to the use of said petitioner, he having paid the same with the costs thereof anl recorded in Judgment Docket No. 28. folio 309, said judgments being as follows: Carrie Helmert. Judgment and costs $265.45; Henry B. Helmert, Judgment and costs $105.45; Frederick Helmert, Judgment and costs $95.45; that said petitioner is advised, believes and therefore avers that said John Dakec left no heirs at law or next of kin in the United States of America, but it is thought that he left a mother named Julia Dakec, who is a non-resident of the State of Maryland and lives in the Kingdom of the Serbs, Croats and Slovenes or Jugo-Slavia and besides said mother, there may be other heirs and next of kin who are unknown to said petitioner. It is thereupon, this 13th day of August, 1924, ordered, by the Circuit Court for Baltimore County, In Equity, that William A. Sullivan, the petitioner, by causing a copy of this order to be inserted in some newspaper published in said Baltimore County, once in each of four successive weeks before the 15th day of September, 1924. give notice to said Julia Dakec and the unknown heirs and next of kin of said John Dakec, deceased, if any there be, the absent defendants, of the object and substance of this petition, warning them to be and appear in this Court in person or by Solicitor, On or before the 1st day of October, 1924; to show cause, if any they may have, why a decree ought not to be passed as prayed.
